Banjska's terrorist attack is continuing to be investigated in detail by the Special Prosecutor. The numerous materials, but also the sending of some tests abroad for examination, seem to delay the prosecution's setting up the indictment a bit.
When about five months have passed since the terrorist attack on Zvecan Banisk, the Special Prosecutor is still continuing the investigation.
The establishment of the indictment seems to take some time.
It has also been done to send some tests abroad for examination.
Apart from the investigations conducted in this case by the prosecution, there are other elements like tools that have been confiscated must be passed through labs which unfortunately in Kosovo are not functioning and must go to other states, it means that the investigation can be extended, but it can be extended even to the time when the act could arise”, Ehat Miftaraj of IKD said.
Former head of the Appeals Court, Hasan Shala, who is now a lawyer, shows that the prosecution can take up to three years to raise the indictment.
If we had a quick indictment, then it really wouldn't be prepared and argued as the Criminal Procedure Code defines. So the Special Prosecutor has to have free hands and work professionally and when he collects all the evidence, then press charges, not file a charge with half evidence or even assumptions. If he is convinced that it is necessary to give this opportunity as well, then the prosecutor can be given another year, so three years extend the investigative procedure”, Hasan Shala has declared Former Court of Appeals chairman.
At a press conference held in December, Interior Minister Jhelal Svecla said he expects police and prosecutors to come up with a report on the case.
This action doesn't seem right to lawyer Shala.
It's not nice before the prosecution comes up with a report. It is good for the prosecution to come up with charges, the prosecution will be public even then, and the opinion will be announced. Before the prosecution arises, it's not good to go public with the report because it can be violated even investigation”, he follows.
The prosecution has not responded to television as to what phase the investigation is at, as well as to questions related to evidence sent abroad.
The main responsibility for the attack has been taken over by Milan Radojicic. However, the lack of co-operation between Kosovo and Serbia will make his sentence difficult. /Dukagini
