With special prosecutor Ilir Morina's proposal, the trial against accused Dejan Rakic, who is charged with sexual rape during the war in Kosovo, has been closed to the public.
Prosecutor Morina stated that under the legal assumption that the accused Rakic does not accept this criminal act, since the same is tried in absentia and that details about the victim's identity can be discussed in this trial, he demanded that the hearing be closed.
The prosecutor also added that during the investigation phase in the concrete case, the judge of the preliminary procedure had issued a safeguard order against the injury and had legal obligation to implement the same.
Even the defender of indictee Rakic, lawyer Osman Mehmeti did not object to the proposal for the session's closure.
So, with the approval of Judge Vesel Ismaili, the judgment continued closed.
Unlike this court, on November 20, 2023, I had begun to hold trial in absentia even against indictees Cedomir Aksic, who is being charged with war crimes in the village of Recak.
The lack of judgment is envisioned with the New Code of Criminal Procedure of the Republic of Kosovo.
According to the Special Prosecutor's Act of the Republic of Kosovo, founded on November 27, 2023, Dejan Racic is charged with the quality of Serbia's military reserve, contrary to the regulars of international humanitarian law during the attack on the Albanian civilian population on the entire territory of Kosovo, with the use of violence and other inhumane acts had committed sexual violations by the wife of Albanian nationalism.
Therefore, Raciq is being charged with criminal work “War crimes against the civilian population” by Article 142 of Yugoslavia's Penal Code, currently incriminating as “Criminations against humanity” from Article 143, paragraph 1, subparagraph 1.7 of the Criminal Code of the Republic of Kosovo. /A Vow for Justice
