The Ministry of Industry, Intervention and Trade (MINT) informs that for cable network services, it has made the decision it has imposed on cable operators to drop unfair conditions in the contract, allowing consumers the right to cut the contract if the operator has failed to fulfil obligations under contract.
MINT points out that it is contrary to the Article for the Protection of Cosumator, the obligation imposed on consumers on the contract to pay the remainder of the contract even if the content of the service has changed.
Full ministry announcement:
The Ministry of Industry, Trade and Protection ( MINT), through the Central Inspectorate of Market Supervisance ( IQMT), after reviewing hundreds of consumer complaints that the Consumer Protection Department has accepted, regarding cable network services has made a decision under which it has imposed cable operators to prevent unfair conditions in the contract, allowing consumers the right to cut the contract if the operator has failed to meet obligations under the contract.
The obligation given to consumers in the case of contract binding to pay for the remainder of the contract, even if the content of service/canals has changed, is contrary to Article 72, paragraph 1, under paragraph 1.15 of Law No. 06/L-034 for Consumer Protection, where it is specified that “conditions considered unfair are the conditions that have the purpose or effect of: The consumer's obligation to fulfil all his obligations when the seller or supplier fails to fulfill his” obligations.
The Ministry of Industry, Intervention and Trade remains committed to protecting the rights of all consumers, so in this case thanks them for their confidence, sending all their complaints to the Consumer Protection Department under MINT for further review by the Central Market Supervisor and other responsible institutions, with careful treatment of any complaints coming from citizens, respectively, consumers.
Consumers can file complaints by calling a free number: 8,00 11,000 or via email address: [email protected].
