The Council for Protection of Human Rights and Freedoms has reacted to the marathon trial process at The Hague to former KLA leaders, calling it “J MARATONIC YXIM IN HAGUA, GUYCHED OUT OF THE STATES!”

Through a media communiqué KMDLNJ say four years have been taking place since Kosovo Liberation Army top leaders and top leaders of Kosovo institutions, President Hashim Thaci, Chief Prime Ministers Jakup Krasniqi and Kadri Veselini, as well as VV-based GP chief Rexhep Selimi are being detained as political hostages in the Raci Court's Pre-milment Unit in The Hague, without a specific date and year of completion of judgment.

“This also said in an interview Ekaterina Trandafilova, the head of this Court, who prays to God that it lasts as long as possible because of the staggering material benefits for him and the lead of the wandering bureaucratics who go to any country where there has been a crisis to continue the dance of extortion at the expense of victims and accused. So far, 44 witnesses of the Special Racist Prosecutor have been heard, most of them are Serbs of Serbia's police and military device or even Albanians who have been recruited and trained by Serbian security to testify against the accused and who are currently being tried”, the communiqué says.

According to the KMDLNJ, these witnesses, currently protected “have testified even in Kosovo as if they had regular public presentations. The procedures before the JSR are largely closed with which the principle of publicity is severely removed, as important as needed by a transparent judgment to obey and ensure that the evidence is correct, with which the judicial decision would be much more reliable.

“Ekaterina Trandafilova, a framework of Todor Zivkov, in not a few cases has violated the principle of presuming innocence by claiming that the accused could be sentenced even to life in prison without facing any opposition from the country's institutions and parliamentary commissions that have the mandate to protect human rights. At the same time in Kosovo “avkat “convicted of extremely immoral violations and acts also violates the principle of presuming innocence by declaring in the media that the accused who are currently being tried should be sentenced no less than by 40 years in prison! Under normal circumstances, the Oda of Kosovo Lawyers would have to take measures for violations of Ethics, but since there is no morality or ethics and no professional and human integrity to them, other measures must be taken. It should even be investigated as to how they won the lawyer's license. There are also at least 100 witnesses of the SPS in The Hague to be questioned, and if they go with the current dynamic it would take another three to (3) years to complete the testimony, then to listen to the witness of the defence side that means that only witnesses will receive the next 4 to 5 years that it is not the reason that, from the Nyrmbergus Process and other similar processes at the Court for the former Yugoslav in The Hague, the Arusha of Tanzania, Leane, and other countries where mass humanitarian law violations and war crimes have been killed by millions, as if the decision is taken within a reasonable term of European law. How events are taking place only listening to witnesses will take, at least 8 years meaning that the accused will so long remain in custody that exceeds any normal term of reasonable judgment and presents flagrant violations of human rights in general and the rights of persons deprived of freedom, in particular. It is incredible and without any logical sense that the Kosovo Assembly, respectively, deputies of this Parliament who say they are founders of this Court, as if even this Court is summoned to Kosovo's laws, although with nothing owes the Assembly of Kosovo and the institutions of the country, do not have the courage to discuss in a session or more parliamentary hearings of flagrant violations that become the highest military and political personalities, all Albanians and all Kosovo citizens. The discussion of human rights violations in no way should and cannot be understood as intervention in justice, but it lacks the will and courage to address the subject. That the position that is in power has no interest in seeking information and clarification for The Hague hostages, it is not hard to understand that the state is doing all it can to make life and protection more difficult, whether it is by cutting off access to legal support through the removal of funds or the objective implementation of the Law, whether through public statements and other ways (the distribution of materials as stated in the media by a senior politician) as well as through protected witnesses for what persons in Kosovo and Albania have been arrested, after this has been stated publicly<3>

KMDLNj publicly condemns even the lack of response of organisations that have exclusive responsibilities in monitoring in this prison as the International Committee of the Red Cross in Geneva, the Netherlands' Ombudsman and, after all, the Special Court's Ombudsman. The Committee for Prevention of Torture and Inhuman Treatment is mandated to visit The Hague prisoners for the fact that they have this mandate worldwide.

How things have been so far, KMDLNY is convinced with nothing that those arrested have the right to a fair, impartial, and undirected judgment by politics and interest groups which guarantee all national and international human rights documents.

“There are doubts beyond the argument of former prosecutor Jack Smith's being involved in nearby corruption for this process as if the SPS has allowed the deliberate flow of sensitive documents, after which they were arrested and sentenced to leading capital sentences of the KLA Vetrans Association, Hysni Gucati and Nasim Haradinaj. There have never been any investigation, and no one has claimed responsibility except the last link subject to responsibility and sentenced by the Court, Gucati and Haradinaj.

To ensure the continuation of this very lucrative business for Ekaterina Trandafilova and its bureaucratic leadership, a legal quality has been established as preventing justice in the name of hundreds of raids in Kosovo, telephones and PCs have been confiscated, as well as books, publishing, photographic albums and others, and numerous persons have been arrested. There is no record of any judicial process of this very long-standing nature, which has transparency under every minimum and where the state is against the accused, who can even be counted as the Founding Fathers of Freedom, Independence and the State of Kosovo”, concludes the communique.
