Entering regularity: Consumers have the right to cut contracts with operators

The regulation has entered into force that enables consumers to cut contracts with cable operators, due to unilateral changes in contractual conditions. ARKEP has said that the regulation is in line with the European Code of Electronic Communications, and its main goal is further empowering consumer rights. For all such cases as unilateral change of contractual conditions, poor service function, or other violation of contractual conditions by service provider, the consumer has the right to early cut the contract.
According to ARKEP, users should be announced no later than 30 days before the amendments are entered into force and should be informed of the right to secession if they do not accept the new conditions.
The right to cut the contract could be exercised within two (2) months after such announcement. Service providers should ensure that the announcement is made in a clear and understandable manner in a stable medium (sms, e-mail or via post office)”, says Article 10 of the regulation.
The new regulations include the possibility of breaking the contract because of poor service operation, that is, if consumers fail to perform as indicated in the contract.
The regulation has clarified that the period set up when the service provider may seek compensation for the premature removal of the contract (over the first nine months when the contract has been bound for 12 months, respectively, the first 12 months when the contract has been linked for 24 months), applies only to cases when all contract conditions from the service provider have been met.
A day earlier, the Ministry of Industry, Trade and Trade after reviewing hundreds of consumer complaints related to cable network services, announced that it has decided to impose on cable operators to drop unfair conditions in the contract, allowing consumers the right to cut the contract if the operator fails to fulfil obligations under the contract.
According to MINT's announcement, the obligation imposed on consumers in the case of contract binding to pay the remainder of the contract, even if the content of the service/canals has changed, is contrary to the law.
