It's disturbing how the Court of Appeals never addresses the problem approach of the Foundation Court in treating and evaluating rape as a criminal offense. Sexual promiscuity is the obligation to perform sexual acts without consent. But the Constitutional Court doesn't know what that means, and misjudges based solely on evidence of physical genius injury. The presence of physical injuries is not crucial to determining rape. The prosecution has provided video footage, testimony given by forensic expert, as well as evidence of extreme cases and violence that indicate that Margona has not been able to show consent to the sexual act. The Foundation Court has completely ignored the video-incriminating and testimony of forensic expert, who testifies to the lack of consent as the essential element of the criminal act of rape, as well as the violent and frightening circumstances in which it occurs.

This Wednesday, we call on popular mobilization to oppose the practice of the justice system in Kosovo, which is showing that it doesn't work for women, enabling them of any kind of justice. The Court of Appeals' decision to retrial the subject of the murder of Marigona Osmani revolts greatly because beyond that, it reflects a frequent practice in cases of violence against women and childicide, which turns the case to zero, creating uncertainty about women in Kosovo and endangers Marigona's injustice even to the dead.
The Court of Appeals in its ruling falls prey to its own criticism because it is not clear and complete in the evaluation of the act. The reasons and demands of the Court of Appeals, where, among other things, are called into question the cruel manner in which Dardan Krivaqa, with the help of Arben Sejdiu, has killed Marigona, is of concern to us. The involvement of the murder motive, which is also problematic in itself, does not rule out that the murder has been committed cruelly, and this is proven across the entire act of the Constitutional Court, even by the testimony of forensic expert and forensic reports. Such a suggestion restores emphasis on the motives of the murder and not the act for what is unacceptable to us.

We are indignant/a and revolted/a with this decision of the Court of Appeals that reflects a deeper systemic problem and the pronounced institutional neglect of women's lives. So we call into organization and attention for this occasion. We cannot allow the case of Marigon to creep into court buildings and eventually deepen the pain of her family. We cannot allow such ping-pong practices with women's lives to become the norm.
We invite you to join us this Wednesday at 12 o'clock, the Palace of Justice, the Court of Appeals to protest and seek justice for Marigon and every other woman, alive or dead.
