Court: Journalist Valon Syla's attackers, motivated by religious beliefs, were violated by freedom of expression

These findings have been issued in the act published by the Constitutional Court in Pristina on the case of a two-year prison sentence against the River Dravishi, Kenan and Okan Hasani, charged with attacking journalist Valon Syla.

In the 23-page court's act of reasoning, he noted that the testimony of the injured Valon Syla has succeeded in proving that the same was hit by the Dravishi River and two others he had not seen.

Also, the court as a noncontroversial fact has found that Syla had posted a sarcastic video on Muslim religion again on Facebook when an imam had accepted a car “Mercedes” from his gelat.
The court ruling states that freedom of expression is also guaranteed in terms of the matter of trust and that no citizen according to the court can be placed on these guaranteed freedoms even with the Constitutions.
As for the court's court sentence, it has clarified that by counting the extenuating circumstances: the relatively new age of the accused and that they have manifested repentance and that as a serious circumstance -- the weight of the work, the tenant for the conduct of criminal work, their conduct in court has come to the conclusion that the appointment of a two-year prison sentence has been adequate.
The incident against the River Dravishi, Kenan and Okan Hasani was founded on August 4th 2023 by the Special Prosecutor of the Republic of Kosovo (PSRK), with the reasoning that on April 11, 2023, about 11:00, influenced by the radical radical ideology of Islam, had easily injured journalist Valon Syla, since he had written in his account in “Facebook” for prophet Muhammad and prophet Isa.
Hence, with these actions, Kenan and Okan Hasani were charged with criminal action “Equipment”, the work punishable by six months to three years in prison under the judicial condition of the indictment.
