An American federal court ruled that Donald Trump could face trial on charges of plotting to overturn the outcome of the 2020 presidential elections, rejecting former presidential claims that he is immune from prosecution.
This ruling is the second in recent months that judges have dismissed Trump's immunity arguments and the court that he could be prosecuted for actions taken at the White House and, on the eve of January 6, 2021, when his supporters attacked the U.S. Congress building.
This ruling also paves the way for further appeals by the former Republican president, and this case could end in the Supreme Court of the United States. The judgment on Trump, on charges related to the overthrow of the election result, was initially set to be held in March, but was postponed last week, and the court judge has not yet set a new date.
“For the purpose of this criminal case, former President Trump has become the citizen Trump with all the defences each other defendant enjoys”, the three-judge panel at the Appeal Court in Columbia County said.
However, any executive immunity that may have protected him in the time he was president no longer protects him from prosecution”.
This decision, expected to be appealed by Trump, rejects his efforts to avoid a trial under the indictment that he has undermined American democracy and the transfer of power, at the time he is consolidating his position as the key candidate to get the nomination for president by the Republicans.
An election campaign and social media campaign has repeatedly claimed immunity. It through a post on January 18th said that “all presidents must have full presidential immunity or authority. The determination of a US president should never be removed”.
The immunity issue was handled by a district court in December, rejecting Trump's claims. Judge Tanja Chutkan's decision, Trump had appealed.
On January 6th, Trump supporters attacked the US Congress at the time the victory in Joe Biden's election was certified. At least nine presona died in Congress during or after the January 6th riots.
Trump has repeatedly repeated his false claims that he had won the election in 2020 and named as patriots the people who attacked Congress. / REL/
