The Republic of Kosovo's criminal procedure code for cases like this one against Agim Ademi envisions that without the consent of the damaged side, prosecution against suspects cannot be suspended.
That no consent has been given for the provisional suspension of the criminal procedure, which was preceded by the throwing of a criminal threat to Agim Ademi, this is confirmed by the Kosovo Tax Administration itself.
In demand for the appointment of house arrest, ATK is considered the damaged party, worth 8,337 euros. The request for house arrest had been issued on March 23, 2023.
“It is not the Kosovo Tax Administration that was consulted. No, there's no pleasure in that I've asked both the legal department and the tax investigation” Bytyci said.
Prosecutor Ali Aydin, who has issued the ruling to close the case, has stated to KALLXO.com that he is unaware whether the ATK consent was taken before prosecution of Agim Ademi was suspended.

In the decision to cast a criminal outcry on September 29, 2023, the prosecution specified that Agim Ademi, M. C., A. D., I. A., and A. N. They had fulfilled their obligations to the prosecution in order to make it a criminal accusation.
These obligations under the decision of September 27th last year had assigned the Ademi group to be paid 13 thousand euros in order to apply alternative procedures to them.
This alternative procedure is known as “Temporary Prosecution of criminal procedure”.
A simple estimate reveals that for the five suspects, each had to pay 2,650 euros to not proceed further with the indictment case.
This money, worth 13 thousand euros, would be deposited in the funding for compensation of the victims.
According to the Criminal Procedure Code, such an action for applying alternative procedure is allowed to the prosecution, but that it should be expressly pleased with the damaged side to apply alternative procedures “temporary privatisation of the penal procedure”.
“Temporary Processing: The state prosecutor, with the consent of the injured, may suspend prosecution for fined offenses or imprisonment of up to four (4) years or fines and imprisonments of up to four (4) years, given the nature, circumstances and character of criminal acts and perpetrators, if the defendant vows to act as instructed by the state prosecutor and that he will meet certain obligations that reduce or avoid the harmful consequences of criminal work, including...<x1-> specified in the Court of Criminal Procedure.
Kosovo Football Federation Chairman Agim Ademi on March 22nd 2023 was detained for 48 hours after interviewing by the Constitutional Prosecutor in Pristina.
