Assembly tear gas case, VV deputy takes time to find a lawyer

Because Vetevendosje Movement MP Valon Ramadani has taken time to appoint another lawyer, he has again failed to hold hearings at the Constitutional Court in Pristina on Tuesday, in the case where the same one is accused of dropping tear gas in the Assembly. The accused Ramadani said he was notified by the lawyer [...] on Friday.

The accused Ramadani said it was announced Friday by his previous lawyer (Naser Soopyan), who has revoted authorisation to represent him in the case, reports “Justice Vowing”.

“I received a notice from the lawyer on Friday, which was reocuked, I asked a lawyer, to find another lawyer”, Ramadani said.

Ramadan for today's session was appointed to lawyer Sahhade Gashi, on official duty.

“You have a target, but I have a menu that he comes in, but I can't contact him much earlier...”, he said, demanding that sessions be postponed to set another defence.

Later, Judge Anita Krasniqi-Penaj approved the accused's request, for delaying this session, so that the same could engage a new defender.

Also, the January 22, 2024, session had failed because lawyer Naser Soopyan was missing.

The Constitutional Prosecutor in Pristina charges Ramadan with two criminal acts and that “Use of the weapon or dangerous tool”, as well as for “Pingim of the official person in carrying out the official task”.

For this case, on July 13th, 2021, at the Constitutional Court in Pristina, initial sessions were held in which MP Ramadani was declared innocent of the criminal acts that weigh him down.

The first-instance court, with the ruling of September 8, 2021, had refused to impose an unequivocal request for dropping the indictment submitted by the defendant Ramadani's defender, arguing that the claims of the same are unstable, unconfirmed and unsupported in any concrete reason.

Against that decision, the Appeals Court had exercised defender Valon Ramadani, lawyer Naser Soopyan.

While, the Court of Appeals on October 8, 2021, had issued a ruling with which he had refused the lawyer Sopijan's complaint with whom he had confirmed the indictment against Ramadan.

Otherwise, Pristina Constitutional Prosecutor, on July 30, 2019, has filed an indictment against Valon Ramadan, with the reasoning that he committed two criminal acts and “the use of a dangerous weapon or tool”, from Article 375, Article 1 of KPRK, and “Pangim of the official person, in carrying out the official task”, from Article 409, paragraph 1 KPRK.

According to the accusation, on March 21, 2018, in Pristina, exactly in the Republic of Kosovo Assembly Hall, accused Ramadani, deputy of the Republic of Kosovo's Parliament, in violation of the applicable law on arms, has used weapons in the manner he has lit up and thrown a tear gas tank during the development of the extraordinary session.

The accusation is said to have prevented officials from carrying out office officials, the deputies of the Kosovo Republic of Kosovo's Parliament, in time, and in the highest manner, the accused Ramadani has been preventing officials from carrying out the official office, respectively, the deputies of the Assembly of the Republic of Kosovo, so that he has used tear gas and the work of the emergency session of the RKS Parliament has been suspended.
