The Foundation Court convicted Naser Hafizin of even “mishandling, intimidation, psychic violence and grave insult to dignity” of signaling for the Ambalnizers

He was even convicted of it by Pristina's Constitutional Court, since according to the judgment that Albian Post holds, Hafizi for two consecutive years, from December 2021 to January 2023, has misused his official duty and authorisations by mishandling, terrified, and severely insulting the dignity of the injury”.

The same “had begun in a constant sign of retaliation by exercising psychic violence, initiating disciplinary measures, by giving written remarks and continuing to influence the release of water permits for several ambalnizers and by making direct interference in its decision making”, it is said in the September 2023 trial.

The defendant is hired to commit criminal work “mishandled during the exercise of official duty or public authorization from Article 195 par.1 of the Republic of Kosovo Penal Code (KPRL)”.

But the story doesn't end here.

A complaint by the official in question was also sent to the Information and Private Agency (AIP), on April 6th of 2023, because its personal data was distributed to the ministry and beyond by Hafizi.

The “complaint in question has voiced concerns that its personal file with its data (the medical report) has been distributed to other officials at the ministry and outside the ministry by sending them to the Department for Management of Public Officials (DMZP), the Ministry of Internal Affairs (MPB)”, said in the decision of the Agency for Information and Private Affairs.

This complaint against the MPHI was approved as based on this agency.

MMPHI, respectively, is explained by AIP, on the request of January 4th, 2017 Public Officials Management Department (DMZP) to MPB for permanent transfer along with medical vacation evidence, in which its diagnosis is described, that is, health data has processed or discovered the personal data of official “in opposition to Article 4, 10 and Article 5 and Article 8 of the Law on Protection of Personal Persons (Trinals) LMPP)”

That's because it's shown that this data has had to be sent to the competent medical body, which is the Health Commission at the Ministry of Finance, Labour and Transfers instead of the DMZP in MPB.

“Personal data regarding the physical or mental health of a physical person, including providing health care services, showing information about his or her state of health, are classified as the category of sensitive personal data”, the document says.

Then, the next MMPHI movement took place on September 22, 2023, after 8 days (14 September 2023), after Hafizi was sentenced by the Court.

The ministry decided to transfer the official to the Kosovo Hydrometeorology Institute in length of six months.

After completing the temporary transfer deadline, the civil servant is said to be returning to his previous position.

“Transfering the official from the point 1 of this decision is made based on the deputy secretary-general's request of the date 22,09.2023 with which the interim transfer of the official in question” is highlighted by the ministry.

Disgusted with this decision, the official filed another complaint with the Independent Council for the Kosovo Civil Service (KPMSHCK), which resulted in being again based.

They concluded that the ministry in question had not done an exact analysis when it decided to transfer the official to another institution.

The professional arrangement of the complaint is not appropriate with professional preparation, the description of the work tasks for the position which has been assigned by transfer, so in the concrete case of the complaint, there has been no correct analysis of meeting the conditions related to the arrangement and the authorisation of the task and duties for another position for the”, explained in the KPMPAK decision.

In that sense, they appreciate that this decision is contrary.

Based on all the available facts, the council in question abolishes the transfer decision and asks the MMPHI to return it to the position it once exercised.

“In order to establish legitimacy and based on authorizations specified in Article 55 paragraph 1 of the Law for General Administrative Procedure has abolished the decision of September 22nd, imposing it The MPHI that within the set deadline as point III of the device will turn the complainer back to the position he had with all the rights and obligations related to her work relationship”.

In contrast, Hafizi and Izedin Bytyqi, two senior officials, have surrendered to seven-month Albanian Post reports on multimillion-dollar abuses and thefts related to the debt of liquor companies and water ambalage at the Ministry of Environment, Spatial Planning and Infrastructure, which is led by Minister Liburn Aliu.

Albanian Post had begun reporting about legal violations in the case of write-off for water bottlers in April this year.

A piece of the scheme had been scrapped, where Naser Hafizi had produced illegal procedures to pay off millions of symbolic debt numbers.

Taking this lead, the Special Prosecutor in co-operation with the Kosovo Police after a several-month investigation organised an action that resulted in the arrest of the ministry's secretary, Izedin Bytyqi, of the search for Naser Hafizi, the task seeker in the position of the Leader of the region's River Parks Authority.

He was later arrested on October 10th and assigned the 30-day detention measure.

Hafizi allegedly committed criminal acts: “Use of official duty or authority” “Money laundering” and “Ab reporting or false reporting of income wealth, gifts, other wealth benefits or financial obligations”.

Meanwhile, Bytyqi according to the Special Prosecutor was suspected of committing criminal acts: “Use of official duty or authority” and “Non-licensit 40x3>.

From the prosecution's investigation, thus far has resulted that Hafizi only in the past 11 months has bought 4 residences and other real estates, until only February of this year has circulated 395 thousand euros in his accounts and at various times deposited 109 euros through the bancomat, until the monthly salary is only 732 euros.

According to the Prosecutor, senior official of The MMPHI has repeatedly entered and left Kosovo within a day from the border crossing between Kosovo and Serbia.

At Wednesday's session in the Kosovo Assembly, a discussion was discussed about the water bottlemers' relatives, but this session was boycotted by power.

Meanwhile, the opposition demanded that adequate measures be taken against responsible persons. /AP
