Chief Speaker Glauk Konjufca with indictment for tear gas
Galuk Konjufca, Parliament Speaker, had forgotten to go to the last session, on December 2023, at the Constitutional Court in Pristina, to face charges filed in 2017 for dropping tear gas in the Assembly. The session was postponed for 2024, where Conjufca will again be introduced to the tribunal.
Konjufca is charged with being held in the Kosovo Assembly Hall on 10 August 2016, where former Speaker Kadri Veselina was present, and former deputies Adam Grabovci, Ismet Beqiri, Sabri Hamiti, Valdete Bajrami, Slobodan Petrovic and MP Pal Lekaj, have put tear gas, with all official persons forced to interrupt the meeting.
On these charges, the same one at the session held on April 19, 2022 was declared innocent.
Currently, the trial against him is in the hearing of witnesses, and who have so far been heard as witnesses by former deputees Adam Grabovci and Ismet Beqiri.
While, in this case, Konjufca has been prescribed to “Pingim of official persons”.
Likewise, Pristina Constitutional Prosecutor, even on February 22, 2016, had filed an indictment against Chief Prosecutor Konjufca, and Pal Lekaj, Besa Buffijat, Aida Drggut, Time Kadrijajt, and Teuta Haxhiut on dropping tear gas at one of the Kosovo Assembly sessions in December 2015.
Even Justice Minister Charged for Tear Gas in the Assembly
Justice Minister Albulen Haxhiu, along with Deputy Pal Lekaj and former Presidents Donika Cadaj-Bujupi and Besa Battiu, are accused of possession of tear gas in the Kosovo Assembly space.
The Pristina Constitutional Prosecutor charges the same with the criminal work “maintaining ownership, control or unauthorized possession of weapons” by Article 374, paragraph 1, of KPRK, which is fined up to 7 thousand and 500 euros or to prison for up to 5 years.
According to the accuser act, on February 19, 2016, after a pause in the work of the Parliament, until Haxhi, Lekaj, Buyup, and Baftiu were returning to the same room, during the control of the Parliament's security workers, a tear tank had been found.
After six failures, the initial examination hearing on the matter was held on April 14, 2021, where the same had been declared innocent of the work they were loaded with.
The Constitutional Court in Pristina, on May 18th, 2021, had acquitted Minister Hadziu, MP Lekaj and former Karadaj-Bujupi and Buffiu of lack of evidence.
However, this ruling has been broken by the Court of Appeals, and the case has turned into retrial.
While at the February 10th 2023 session, the Constitutional Court has decided to become a ballistic expertise abroad.
Education chief charged with possession of spray in Parliament
The current Minister of Education, Science, Technology and Innovation (MASHTI), Arberie Nagavci, is facing trial over the arms-free prosecution after charging that she possessed swastika in the Kosovo Assembly.
At the June 10th 2022 session, Nagavci was declared innocent of the burden of criminal acts.
And in the second review, she had stated that her actions have been of political nature, with the goal of meeting the obligation as deputy, for protecting the country's best interest.

The Act against Minister Nagavci turns out to have been exercised in court on July 30th 2019.
She is charged that on March 21st 2018, during the session held in the Kosovo Parliament, in which tear gas was poured, while police searched, she had been found a green spray with black spraying parts.

Minister Hajdari convicted of unreported wealth and counter-invention
Industry, Intervention and Trade Minister (MINT) Roseta Hajdari, on December 29, 2023, from the Constitutional Court in Pristina has been sentenced to 700 euros in fines in connection with the charge of defaulting property within the legal deadline, which ruling on February 20, 2023 has taken the stamp of inadequacy.
For that charge, she had pleaded guilty at the initial session.
According to the indictment compiled on October 13th 2022, by Pristina's Founding Prosecutor Roseta Hajdari was accused of failing to declare property within the legal deadline.
With this, Hajdari was accused of committing criminal work “underreporting or false reporting of property, income, gift, other material benefits or financial obligations”, from Article 430, paragraph 1 of the Republic of Kosovo Penal Code (KPRK), this work punishable by fine or prison for up to three years.
The same court, Minister Hajdari on October 24th 2023, has sentenced him to 200 euros in fines for the charge of an accident where he hit a child. And that verdict is confirmed by the Court of Appeals.
In this case, Hajdari's request for the initiative of the counter-invention procedure was made by the Kosovo police station, the Kosovo Police ʹ Regional Road Communications Unit, for the accident that took place on 10 April 2022, around 12:25 on the “Vicianum”, in Pristina's “district of Arberia”
At the same request, Hajdari was charged with “oversufficiency of speed” and “axident communication with body injury”.
Svechla and others are presented for hooliganism during the protest
On June 27, 2023, current Minister of Internal Affairs Jalal Svecla, along with Social Democrat Party Chairman Dardan Moliqaj and others, has been described as the indictment for hooliganism during the 2013 VV protest.
Minister Svechla and three Vetevendosje deputies charged with tear gas

Svechla, Milaku, Zyba and Pacoli-Dalip are charged with using the gun from Article 375, paragraph 1 of the Penal Code, whose chief is sentenced to imprisonment of 1 to 8 years and obstructing the official person in carrying out duties from Article 409, paragraph 1 of the Penal Code, for obstructing Kosovo Assembly deputies in performing official duties. The head of this work is sentenced to prison for three months to three years.
Agreement in Parliament, deputy prime minister with indictment along with three PDK deputies

Actuals against MP Paul Lekaj
The Special Prosecutor of the Republic of Kosovo (PSRK) on February 4th 2022 has filed charges against the Alliance for the Future of Kosovo deputy (AAK), Pal Lekaj, the former minister of Infrastructure, who is charged with corruption, in the case known as “53 millionshi”.
MP Lekaj along with Esset Berisha, his senior political adviser, Ne praising Shatrin, former Secretary General at the Ministry of Infrastructure and Besim Tahiri, director of Public Procurement, by the Special Prosecutor, is charged that, in co-ordination, “The use of official position or authority”, by Article 422, par.1 concerning Article 31 of KPR, this work has been condemned to 6 months to 5 years.
Currently, this case is still in the phase of trial review at the Special Department of the Foundation Court in Pristina.
Pal Lekaj faces indictment for tear gas drop in Parliament
Lekaj is also facing charges that in November 2015, the deputy's quality has thrown tear gas into the Kosovo Assembly Hall. The act against him turns out to have been exercised in court on June 1, 2017.

MP Haxhi Avdyli on charges of nonreporting property
Haxhi Avdyli, MP from the ranks of the Vetvendosje Parliamentary Movement Group, is accused of failing to report property within the legal deadline, which the same charge on February 8, 2023, was declared innocent.
The Constitutional Prosecutor in Pristina on 20 May 2022 has filed an indictment against Haxhi Avvdyli, who is tasked with not reporting property within the legal deadline.
According to the indictment, on 31 March 2021, defendant Avdyli, in the quality of the top public official, as deputy of the Kosovo Republic Parliament, has not made the regular annual declaration of property within the legal deadline.
MP Xhavit Haliti charged with attack on MP Arben Gashi
As a result of a physical contact that had taken place on May 18th 2018 in the Republic of Kosovo Assembly, among the Parliamentary MP from the Democratic Party of Kosovo (PDK), Xhavit Haliti, and Democratic League of Kosovo deputy (LDK), Arben Gashi, the Constitutional Prosecutor in Pristina, had filed an indictment against Halit.
Apart from him, the indictment has also been charged with the former delegation from the Alliance for the Future of Kosovo (AAK), Ghani Dresaj, who allegedly threatened MP Gashi on the same day.
According to the indictment of May 31, 2019, Haliti is accused of committing criminal acts “Attack”, while fueling for criminal work “calving”.
The prosecution, along with the indictment, has made the proposal that the penalty order be pronounced against them in penalty sentences.
The Constitutional Court in Pristina on October 25th 2019 had fined MP Xhavit Haliti out of the Alliance for the Future of Kosovo (AAK), Guni Dresaj, for assault and slaughter of Democratic League of Kosovo deputy (LDK), Arben Gashi.
Against the decision to render the punishment order, within the legal deadline it had brought opposition to the defense of accused Haliti, who was even approved.
However, judicial review of Halit still continues at the Constitutional Court in Pristina, while on May 18th, 2024 this case reaches the prescription of prosecution.
MP Valon Ramadani charged with two criminal acts
For throwing tear gas into the Kosovo Assembly, MP from the Vetevendosje Movement ranks Valon Ramadani, a former candidate for chairman of the Ferizaj municipality, is also charged.
MP Ramadani is being charged by the prosecution that on March 21, 2018, at the extraordinary session under way in the Republic of Kosovo's Assembly, he had thrown tear gas, as well as prevented Kosovo's Parliament deputies, with what cases had ended the work of this session.
The same is charged with two criminal acts, and that “The use of weapons or dangerous tool”, by Article 375, par.1 of KPRK, which is sentenced to jail for 1 to 8 years, and for criminal work “Pingim of the official person, in carrying out the official task”, from Article 409, par.1 of KPRK, punishable by 3 months to 3 years.
The Constitutional Court in Pristina in September 2021 had confirmed the indictment against MP Ramadani, but even after complaints the indictment had been confirmed by the Court of Appeals. While the trial is not yet scheduled for the case.
MP Salih Zyba charged with assaulting police
To Vetevendosje MP Salih Zyba, the charge is that in August 2015, he has insulted and physically attacked two police officials at the Pristina municipality, who had suffered slight bodily injuries.
The Constitutional Prosecutor in Pristina with the indictment compiled on January 29, 2016, Zyba accuses him of committing criminal work “Attacking the official person during the official task of” by Article 410, paragraph 2 of KPRK, the act punishable by imprisonment of six months to 5 years.
In this case, according to the subject paperwork, on June 10, 2021 at the Constitutional Court in Pristina, initial sessions were held, in which the accused Zyba was declared innocent.
In this regard, this court on July 1, 2021, had confirmed the indictment against MP Zyba, later on July 23, 2021, the Court of Appeals had confirmed the indictment. Until now, however, judicial examination has not yet been appointed by the court.
The IKD has consistently threatened that those who have problems with the law do not exercise public functions as well as not be included in election lists. This in order to ensure integrity in government, conveying the message of obligation to respect the law to citizens. Although the same is true of the presumption of innocence, it no doubt tastes bitter to the public and dims the image of the politician when such ones face justice for various criminal acts and some for corrupt acts as well.
