Those arrested for terrorist attacks on Kosovo Police on Sunday in Banjska in Zvecan could be sentenced from 25 years to life in prison, says Gezim Shala of the Kosovo Institute for Justice (IKD).

According to him, the same for the serious criminal act of terrorism will be tried in Kosovo, until it is impossible for them to be extradited to Serbia due to the lack of international judicial co-operation agreement, Kankosova.tv submits.

Likewise, Shala does not expect Serbia to hand over fugitive criminals to Kosovo in the north, despite yesterday's calls by Interior Minister Jelal Svecla.

Shala from the IKD tells Kosovo Press that under the Kosovo Criminal Code of Terrorism, the criminal act of terrorism is among the most punishable and serious acts in Kosovo.

In the concrete case, we are dealing with criminal acts of terrorism. Criminal acts of terrorism are among the most punishable and serious acts envisioned in the Criminal Code of the Republic of Kosovo. If we really define what we mean by terrorism, the conduct of actions prescribed by law of spoiled criminal acts, which are aimed at destabilising the country, creating fear in the wider population and others. If we look at the sentences defined with the Penal Code, then initially the lowest sentences are up to 25 years. Meanwhile, in certain situations if a terrorist attack ends with a person's death then the sentences are up to life in prison. Let us not forget that in order to prevent terrorism under the Criminal Code, a number of other works that incriminate various actions have been established in order to prevent terrorism. As is the preparation of criminal acts of terrorism, assistance after committing criminal acts and others”, he says.

According to him, all persons who have committed the criminal act of terrorism and are caught in the country's territory must be tried in Kosovo, regardless of their nationality.

“Criminal works have been committed in the Republic of Kosovo and in definitions for the country of committing crime and the issue of competence, in concrete cases we don't even have agreements for judicial-international co-operation with Serbia. This suggests that those who committed this criminal act and were detained in the Republic of Kosovo must be tried in Kosovo no matter their nationality. In the concretely well-protected case is the Republic of Kosovo, and the work has been carried out on Kosovo territory”, Shala adds.

He sees it difficult for fugitives in Serbia, some of them being treated even at the regional hospital in Novi Pazar to be extradited to Kosovo if the same are arrested by Serbian authorities.

And we don't even have an agreement on international judicial co-operation with Serbia. In the absence of this agreement, reciprocity in some cases applies that does not exist as well in the concrete case. Now it happens that in this situation, starting with these two aspects and by the way Serbia has acted in the past, we cannot extradite the same. It remains to be seen how Serbia will deal with those with its system and its justice system institutions. But in this situation what we are Kosovo cannot extradite the persons who have already left Kosovo, except if the same are seized in another state that has some” agreement, he points out.

The Constitutional Court in Pristina has placed one month in custody for two suspects in the attack on Kosovo Police in the village of Banjska in Zvecan.

In the early hours of Sunday morning, Kosovo Police Sergeant Africa Bunnjak was killed, while other police officers were injured. The serious event has occurred in the village of Banjska of Zvecan, where Serb terrorists have attacked the police patrol, to take refuge later at the Banjska Monastery.

According to official information, three attackers have been killed while six people have been arrested. During the action, Kosovo Police have found arsenals of weapons of various calibres, explosives, ammunition and logistics capable of equipping hundreds of people.
