PDK: President and Government Enter Constitution for Second Time

Gruda, at a media conference, said this is an unprecedented act of public fraud and deliberate violation of the Constitution, because the Constitutional Court's decisions are binding on all public authorities in Kosovo.

With this act, unfortunately, the president of Kosovo, who has decreed this law, has committed violations of the Constitution, thus joining the government's continuing violations. Having failed to impose their political agenda in legislation on normal constitutional path, the parliamentary majority in co-operation with the president have decided to perform an unprecedented act of public fraud with the text of law and violation of the Constitution”, Gruda said.

Gruda stressed that through this law, power aimed at bringing the state administration into party service.

The Gjykata has found a series of remarks, especially the collapse of what was called by the Government as “Employment Persitor”, claiming that this criterion, as it is, is unconstitutional and cannot be included in the law. The Kosovo Assembly and the president of Kosovo were charged in the act, so that the law would be decreed and published in the official newspaper without that formulation. So the law would be cleared of suitability criteria. To our surprise, when we received the law published in the Official Journal, we found that something has never happened in the constitutional and parliamentary experience of independent Kosovo. The law was decreed without addressing the Constitutional Court's request for the removal of adaptability. Thus, adaptability exists today in the Presidential Law and was published in the Official Journal, although the Constitutional Court had overturned it”, he added.

Gruda said that current power will be remembered for the systematic violations he has committed to the Constitution of the Republic of Kosovo.

The “One thing is certain, that this power, in addition to extreme ill-governance, international isolation, corruption, will be remembered most of the systematic violations that it has done to our state's highest judicial act of constitution”, Gruda stressed.
