The Constitutional Court in Gjakova has approved Gjakova's Constitutional Prosecutor's request, assigning the detention measure to a (1) month of defendants I. Mr., who allegedly killed a man in the Malisheva Basja.
According to the request, the “dated September 2023 about 7:40 minutes in the village of Bellanica, the Malisheva municipality, in the market parking lot M.-M. has deliberately deprived the dead now of life. By these actions, the defendant is suspected to have committed criminal acts, “murder” and” Possession, control or unauthorized possession of weapons” sanctioned with the Criminal Code of the Republic of Kosovo.
The trial of the preliminary procedure, Sultan Dobraj, has estimated that legal conditions for appointing the detention measure for the defendant in question have been met, so with the possible finding of the defendants in freedom there is the risk of repeating criminal acts, the risk of running away and the impact on witnesses. The defendant will be held in custody for a month, which will be counted from the time of his arrest on September 2023 and will last until October 20, 2023. The sides have the right to appeal to this ruling at the Kosovo Court of Appeals”, said the Court further.
