The Special Prosecutor (SPAK) has sought to ask former Prime Minister Shkelzen Berisha's son and former official Aldo Bumci on the Gerdec case.
The event linking Aldo Bumci with Shkelzen Berisha is a fax in which the contents of the approval letter from the Ministry of Justice for the contract to be tied to Gerdec, a copy from Aldo Bumci's office has been sent privately to Shkelzen Berisha.
Fex is seized by the prosecution in material found after tragedy at the Ministry of Defence.
Former Defence Minister Fatmir Mediu earlier requested the questioning of 90 witnesses regarding the reopening process of the Gerdec case.
On the basis of a request made to the Anti-Corruption and Organised Crime Court, Media lawyers argued that it is necessary for the process to be recognised by these evidence, including former senior Albanian officials in the field of defence, NATO generals, as well as experts and defence officials at the US State Department.
Also requested has been testimony from former defence ministers in Germany, Italy and Northern Macedonia.
This request from lawyers comes after you give up the short trial for Mediu.
The fact that there will be a request for something like this, has been first announced since 18 July by former minister's lawyers, but without specifying the statue of these figures.
We don't believe the explosion was an accident. We have indices for the purpose of firing at the 148x1> demonstration plant, Visha said.
In the common trial, lawyers said they would ask for witnesses who were not asked earlier.
Also the question of the defendants who have concluded the trial and carried out a new act of investigation due to the explosion of the Gerdec ammunition demonstration factory.
We remember that 109 people injured and family members of the victims have brought representation documents to the Court and the SPACE will verify whether they are damaged by criminal acts or not.
Building the Situation
Mediu has been convicted of the “Grdec” case, where 26 people and hundreds of others were injured remained dead.
So far the JCKKO has accepted a cut trial for Mediu, who is charged with abuse of dual office under the Penal Code and the Military Criminal Code.
On January 10th, Mediu was officially taken into custody by the Special Prosecutor and declared that day that “was presented the same facillum, with the same prosecutor, the same charge without adding any additional documents from 2009”.
It was the Supreme Court in Albania, which on October 28, 2021, deposited the file for the former minister in the SPAK and would be the Special Court of Appeals, which would pave the way for investigations.
That was after 12 October suggesting that Mediu was not tried before because of the immunity of the MP he owned at the time.
Furthermore, it is suggested that prescription deadlines have been respected, as Mediu has been taken into custody since 2009.
On the other hand, the decline in the condition, now, immunity, will open the door to justice to start judgment.
The Media Judgment Returned On May 7th, when the seven-year-old family, who lost their lives, filed the SPAK request for Media prosecution.
The SPAK, shortly after reviewing the request, called for the opening of the file and the revocation of the criminal case's dismissal decision against Mediu.
The cause, for which the High Court's College in 2009 decided to drop the criminal case against Mediu, was parliamentary immunity.
On June 30th, the Supreme Court declared noncompence for the trial of former Defense Minister.
Following the legal changes made to justice reform, the case “Grdecy” was passed to the Anti-Corruption Special Court.
Meanwhile JCKKO, July 27th, decided Fatmir Mediu will not be tried.
This court ruled that, since 2012, and then (more than eight years), the prosecution body did not take the necessary steps under the law to exercise criminal prosecution.
“Procuroria has had no obstacle to retake the defendants to citizen Fatmir Mediu without requiring authorisation for prosecution, or seeking revision of the” decision, the JKKO ruling said.
Thus, the Court revealed that the opening of the file “Grdec”, “could no longer be exercised based on Article 66 letters of the Penal Code and on Article 328 points 1] K. P. Criminal”
But The SPAK complained in Apel the JKKO decision, naming it unbased in law.
Mediu accused of committing criminal work “Using task” conducted in co-operation.
As well as for performing criminal work “Disuse of task” in collaboration with military-command subject.
Gerdec blast
