Supreme decision expected after September regarding possibility of release of Haradinaj's Gucati

So declared Nasim Haradinaj's lawyer, Toby Cadman. He has said Apel's decision is not expected before September.

The Prosecutor's Consolidated Answer to our complaint was submitted on July 3, 2023, and our response will be delivered until August 3, 2023. Thereafter, the College of the Supreme Court has 60 days to issue its decision. In our complaint we have requested oral hearing, but the court has not yet decided on it. We do not anticipate the College of the Supreme Court making a decision long before the start until mid-September”, Cadman said.

Haradinaj's lawyer stresses that his expectations are for Haradinaj to be released immediately. According to him, each reduced sentence means release.

We expect the complaint to be correctly and independently determined by the Supreme Court College and that the only righteous result would be to break up Mr. Haradinaj from custody. The College of the Supreme Court can basically order retrial or reduce sentence. Any decrease in sentence would ultimately imply Mr. Haradinaj from custody. However, while we ask for full release, we can only speculate on the outcome of the” appeal, Toby Cadman said.

Hysni Gucati's Nasim Haradinaj was originally sentenced to four years and six months in prison. Following a complaint at the Court of Appeals, the sentence was reduced to four years and three months. Knowing that both were arrested in September 2020, then much of the sentence was held.

As a result, Toby Cadman has indicated that they will seek Nasim Haradinaj's early release.

“Z. Haradinaj will have arrived soon two-thirds of his sentence, so he qualifies for easing the sentence, or early release. We are in the process of preparing the request and I will meet with Mr. Haradinaj this week to further discuss the issue.
