Minister Arberie Nagavci, who violated the Constitution, is now jeopardizing the start of the new school year

Kosovo's Constitutional Court has confirmed that two government minister Kurti has violated the Constitution.

Arberie Navevac of Education and Albulen Haxhiu of Justice were confirmed as violators of the country's highest legal act.

Months ago, on March 25th, this court has declared the Law unconstitutional to the Prosecutorial Council. The Constitution ruled that the law conflicts with provisions of the Constitution for the form of governance and power sharing, the competencies of the Parliament, the role of the ombudsman, equality before the law, and the article for the KKP.

And in April 2022, the Constitution had concluded that the Minister of Education, Arberie Nagavci, has exceeded the ministry's competencies and violated the responsibilities of municipal power in the reform that former Kamenica head Central Kastrate had launched.

But Nagavci is currently on the sting of criticism. A few days before the start of the new school year, the Ministry of Education warned that textbooks should be purchased by students' parents, and that the same would then be repaid.

She has said that the institution she heads has failed to reach agreements with publishing houses for providing schools with books, because, according to her, publishing houses have offered prices far higher than those they place in their libraries.

This year we are considering the possibility that the transfer of tools for providing textbooks under the AugustII legal obligation be done in the parents' accounts and the same thing buys textbooks for their children. Soon in two days, it will be set up for this course that we are considering. We have also prepared the platform for application on the e-Kosovo platform with all other details and have considered all possibilities that on one side we have quality textbooks for children and care for the state budget”, she said.

That warning of Nagavci also prompted calls for resignation as fear grew for the development of the learning process.

Resigning Requests

Education directors from the PDK ranks to the municipal level yesterday held a media conference in which they have expressed great disappointment with the latest proposal of Education Minister Arberie Nagavci regarding supplies to students' textbooks.

Besiane Musmurat, Education Director in the Pristina municipality, has said that over 300 thousand Kosovo families will be forced to buy books for their children, uncertain “whether they will ever be repaid money, or whether they will be enough to buy the books for their children”.

Expressing the application, the LDK argued that buying textbooks from parents costs 20 percent higher than through procurement procedures.

The price of books will be minimally 20 percent more expensive. We request the immediate resignation of Minister Nagavci due to mismanagement, systematic violations of the laws in power and anarchy created in the education system. Kosovo does not deserve a minister who has failed to manage every level of education”, said the LDK's Jehona Lushaku.

And AAK Parliamentary Group chief Besnik Tahiri says the Ministry's proposal is to promote strikes in education.

The decision is to provoke strikes, undermine public education and create a crisis and financially harm the citizen. This situation could end and stop only with the dismissal of this government”, Tahiri said.

The warning did not go unnoticed by the head of SBASAK, Nundman Jasharaj, who said this decision is ridiculous and that Minister Nagavci has shown unripe and cynical “”.

Publishing Home Reaction

Following these statements, the publishing house “Dukagini” reacted, saying they offered at a cheaper price of 4 percent compared to last year.

Our publishing house, for the sake of transparency, wants to announce the public opinion that in the offer we have made in the ministry, despite inflation and global price hikes, we have offered at a cheaper price of about 4% compared to 2022. Despite this, the publishing house “Dukagini” will do its best to fulfil the obligations stemming from legislation to force”, said in response.

Meanwhile, publishing house “Laguas” has said that Education Minister Arberie Nagavci lied about book prices and that the list of selected textbooks from schools is public. They said that they would accuse him of slander.

“Full failure in the process of providing students with textbooks has only one name and he is Minister Nagavci with her cabinet. To cover this failure, he announced an idea that degrades the process into anarchy and served with lies. The two lies that are easier to prove are: lies about the awards of the House of Publishing “L drejtaasi” and the lie that the list of selected textbooks is public”, said the editorial house response.
