First Victory
The court today has decided to block the government in its attempt to shut down Klan Kosovo. The decision is a temporary measure of security that is in force until it is set for the indictment as a whole.
According to the ruling, the arguments that have prompted the court to postpone the execution of MINT's decision are:
- Decision leaves District Kosovo without legal registration, and therefore cannot exercise economic activities
- Decision to result in KPM's obtaining license
- The work relationship of 220 workers would be interrupted
But the most important aspects the court has said are the same as we've told him two months ago.
- a) Kosovo clan has made needed technical improvements in Macedonia business registration and
- The decision has implications for media freedom.
Today's judicial decision, although temporary, is a very powerful indicator that the government's attempt to close the clan Kosovo is illegal, arbitrary, unproportional and at great risk for media pluralism.
This ruling gives Klan Kosovo room to continue operating freely in the next two years until the court decides on their indictment. MINT certainly appeals, but I believe the appeal decides the same.
However, this decision does not change the approach of the government that at any cost and in any form fights the media and journalists by denigrating them with dangerous languages and with consequences for them, not defending them physically during tensions and trying to shut them down.
The Independent Commission for Media (KPM) is obliged to issue a decision confirming that the Clan business certificate issue will address it after the final judicial decision.
Let's not forget, at an important moment for media freedom, the KPM is the professional market, right and clearly on the side of media freedom as never before. I have faith in the KPM chairman and several members. Bravo.
