Venkateswari Alagedra, lawyer of former Prime Minister Jakup Krasniqi, has demanded that her client be released temporarily to spend some time with his family in Kosovo.
Taking into account the summer holidays at the Special Court in The Hague, Krasniqi's lawyer has demanded that he be released for two weeks. The defence in its bid stresses that Krasniqi is in custody for two years and eight months, demanding that he be released under surveillance.
Krasniqi's lawyer claims Krasniqi's detention is not necessary, as there is no danger of escaping and obstructing judicial procedures.
Mr. Krasniqi is an exercise of free speech and not enough to show a trend towards intervention in the witness”, said the Alagedra lawyer's parliament. She adds that there is sufficient reason to justify Krasniqi's failure and that there is no concrete evidence that any witnesses have been intimidated by Krasniqi, the Express newspaper reports.
Second, defence stresses that Mr. Krasniqi for the performance of the case over the past four months actually reduces the likelihood that it will be included in any banned” activity.
The programme has so far called its first 11 witnesses. No one has spoken ill of Mr. Krasniqi. [ REDECT]. The evidence the panel has heard does not support that characterisation of Mr. Krasniqi as the person likely to intervene in witnesses or commit further crime. Moreover, it is difficult to understand what the prosecution suggests would be Mr. Krasniqi to intimidate protected witnesses of the victims in this case, whose overwhelming majority, as the Judicial Chamber would have observed, do not mention at all Mr. Krasniqi or just say they knew he was the spokesman KLA”, said in the parachute.
Third, the lawyer stresses that “Paneli now has an experience observed the effect of detention and prolonged trial for Mr. Krasniqi”
“At the age of 72, he is evidently older than the other accused in this case, writes lawyer Alagedra.
Several other conditions, such as the two-week release of Krasniqi, where he will live, limited contacts, and who will live with him, have been offered.
In the alternative, defence requires that, if the provisional release is refused, Krasniqi is allowed “additional private visits to the Para-burg unit during summer vacation” to have extra time to spend with the family.
