The Ministry of Infrastructure has signed five contracts for the “National Road expansion N25 project, Pristina-Bessi Podujevo. The roads he has chosen to contract for this project are illegal.
The Ministry's procurement violated the law once again as it signed the contracts. This has been due to the fact that in the Procuring Organisation -OSHP there has been a complaint handed down by a company, and the moment a complaint is filed, procurement procedures should be suspended until its final treatment.
Based on the OSHP website, it is seen that the complaint was filed on 15/06/2023, and immediately afterward the secretariat of O The E.P. has authorized an expert to review the evidence, so they can then be presented to the panel of the body to make a decision.
But even after about two months, O expert The EP has yet to draft a report of expertise regarding that complaint.
Public Procuration Law, namely Article 114, speaks of “The responsibility of the examiner and contracting authority”. It says “The examiner, in the ten-day term, will: (i) review the procurement documentation of contracting authority and relevant notes, (i) interview, if he sees fit or necessary, any official, officer or adviser to the contracting authority or party, and (ii) equips the examination panel, the complainer and the chairman of the contracting authority with an assessment on procurement activity and the validity of all claims involved in the <3>.
