(3 years ago)The Constitutional Court has rejected the provisional requirement for decisions adopted at the Assembly session on 13 July, when beating among MPs took place. “Requestors have not submitted any evidence or reasoning as to why the suspension of the effect of all decisions approved at the 13 July session contributes to the suspension of risks or irreparable damages and, as a result, public interest”, says the Constitutional assessment of the PDK's request for the suspension of the 13 July session decisions, the Insander newspaper.
The “in light of the principle of judicial security, as the essential value of the rule of law and constitutional order of Kosovo, the Court has decided to reject the request for the provisional measure to the act disputed in question, stressing that such a decision does not in any way prejudge the tribunal's assessment of the basic demand, respectively, for assessing the constitutionality of the act opposed to”.
The Constitution on the same day praised as unconstitutional the dismissal of members of the RTK board by power.
