Where does the Civil-Jurist Code Bill remain strongly criticised for the delay

The Civil Code bill is already almost finalised, with adequate changes even in Article 1138. This has been confirmed for Radio Kosovo by Genc Nimoni, chief of cabinet in the Ministry of Justice. Civil society lawyers say the Civil Code Bill has had to be adopted much earlier in the Kosovo Assembly. In March [...]
In March of last year, Kosovo's Assembly did not spend its first reading on Civil Projectodine.
The point that MPs were at odds during the session was Article 1138, which would enable the drafting of a special law through which the record of “civil co-ordination” would be allowed between persons with the same gender.
Since then, the Government of Kosovo has declared that they have worked on changing the draft, especially at Article 1138.
Genc Nimoni, chief of cabinet at the Ministry of Justice, has confirmed to Radio Kosovo through enamel that “Draft of the Civil Code is already almost finalised, with adequate changes even at Article 1138. Very soon the finalised draft will be prosecuted for voting in Government,” has written it.
Eranda Zekaj from the Kosovo Institute for Justice tells Radio Kosovo that it takes on the importance of adopting the Civil Code, it should be approved as soon as possible in the Assembly.
CUT “Adoption of the Code would greatly facilitate the lives of citizens and address their own cases and protection in court. The code would summarize in a coded form all those outdated laws. Then it should be considered the great importance that our international partners have given to the Civil Code and the great financial assistance so that this code must be adopted as soon as possible. ”
Among those who voted against the Government-sponsored Civil Code were several deputies of the Vetevendosje Movement and of communities not majority.
Albana Hasani, from the “Movement, speaks”, says that failure to adopt the Civil Code indicates the lack of political consensus among MPs.
CUT” Do not adopt this important document, there are long-term legal consequences. But the main burden falls on the MPs, and for that we insist on making the necessary measures for this document to be adopted as soon as possible. ”
The Civil Code contains 1630 articles and is considered the most important document after the Constitution, which regulates and promotes different segments of life, such as legal equality, human rights, property issues, economic transactions, contracts, family relations, children's rights and legacy.
Reactions from Civil Code Designer
Hadzi Gashi, professor of Civil Law at the University of Pristina who had participated in drafting the Civil Code, had told Radio Kosovo that MPs would first have to pass the Code, and that there would then be discussions on certain articles.
It's a concern for all of us who worked on the projectod, including the international factor, that 1630 articles should not be approved because of a article, because there are always solutions. The document would have to be adopted and then during later stages viewed the best possible versions, always in accordance with the constitution. There is no right to deny, or to reduce one's rights, if the constitution allows it, then why the constitution sometimes is not very exclusive in this respect, yet it prohibits discrimination. ”
For not voting the Civil Code, the international factor in the country has also reacted.
The head of the EU Office in Kosovo, Thomas Szunyog. In an interview for Radio Kosovo, he had said that the Civil Code cannot remain hostage to Article 1132 (the one for co-existence among persons of the same gender). According to him, the adoption of the draft code paves the way for political debate.
And O'S chief The SEU in Pristina, Michael Davenport, had indicated to Radio Kosovo that, in a key respect, this legal act would help Kosovo's legislation comply with international obligations in Kosovo in many legal areas.
