As they say by AVONET, nurse A.A., was employed at this hospital, although she is not a citizen of the Republic of Kosovo, but of Serbia, writes the Reporter.net online.
This conflicts with the Law for Public Officials, where paragraph 1, point 1.1 of this law says the general requirement for accepting public officials is to be citizens of the Republic of Kosovo.
“In approach to public documents we have managed to ensure that it does not have IDs of the Republic of Kosovo and that there is only permission issued by the Ministry of Internal Affairs of the Republic of Kosovo on the 2307.2021, which has not in fact met the condition of the competition which is first to have identification and Article 8 of the No Law. 06/L-14 For public officials, who see that to be employed: paragraph 1. General requirements for the admission of public officials and subparagraph 1.1. to be a citizen of the Republic of Kosovo, in this case this candidate has not met this constitutional criterion”, said their media communiqué.
According to AVONET, misuse of official duty in the case of the nurse in question has occurred at two levels.
“for the first time, in its employment process without work permits and illegally; and for the second time, in violating the working conditions of Nurse without labour licenses. These actions of official persons, who violate the law and cause negative consequences, are described and punished with importance by the Penal Code under Article 1414”.
On the other hand, the other violation says it is the fact that a candidate who has not met the pre-priced criteria has been given the right to other candidates.
This action allegedly committed criminal acts under the Penal Code, Article 219 -Containing employment rights and unemployment”.
As a result, AV ONET has asked the State Prosecutor to start investigations into the Hospital Executive Director of the ZKA (chief administrative official), the entity for human resources and members of the selection commission.
“AVONET has sent report and informed MSH and SHSKUK, where he has requested from the Secretary of the Ministry of Health and Head of the USKKUK Board, that the research findings take action against persons responsible for the constitutional laws and regulations”, concludes the communiqué.
