The administrative direction for the departure of the mayors, KDI: Secondary legislation cannot overcome law in force

KDI has said that to pave the way for full suspension, current mayors of municipalities must consider resignations from their positions, to enable citizens to elect their legitimate representatives.

The resignations also allow a new election process in the nearest deadlines, without procedural delays and double costs”, the institute's announcement said.

At the same time, KDI has called on all citizens of the four northern municipalities, in particular those from among the Serb community, as well as political subjects representing their interests, “to pledge that they will participate in the elections, in order that the mayors' resignations do not bring a new process, but with the same results of”.

“also, KDI recalls that existing secondary legislation is not enough to develop the procedure for the removal of the mayors, since procedure deadlines are not defined, the way to verify the validity of the exit demand, nor the modalities for voting development. Even the MAPL initiative for drafting an administrative directive is not enough, since drafting acts on the part of the CEC is also needed as a carrier of the voting process. However, secondary legislation cannot exceed the legal definitions prior to the law in force”, KDI has said.
