Pristina, July 19th 2023 The Special Department has ruled on the request of the Special Prosecutor of the Republic of Kosovo for the appointment of the detention measure against indictees I.A suspected of criminal acts of murder by Article 147 paragraphs 1, under paragraph 3 and 9 concerning Article 23 of the Kosovo Criminal Code.
The preliminary procedure judge has approved as based on the special request of the Republic of Kosovo for the appointment of the detention measure against indictees I.A. and the same was assigned the detention measure, in length of 1 (a) month.
The preliminary procedure judge has examined all the reasons for the detention assignment against defendant I.A and has estimated that the criteria from Article 184 paragraph 1 under paragraph 1.2 points 1.2.1 are fulfilled. The KPRK's, as a special condition for the detention assignment, because there are circumstances that show the risk of running the defendants, since the same suspect of serious criminal acts for which by law a high prison sentence is presented, adding that the defendant from 2008 has been on the run, so based on the defendant's past and his conduct in relation to the law enforcement agencies, the court considers that if the same is found in freedom, there is danger of escaping and becoming impervious to justice organs, so the detention measure is the only provision for the provision of the provision without obstruction of this criminal procedure in this criminal phase, at this criminal phase.
Against this act, disgruntled parties have the right to complaint at the Court of Appeals, through the Constitutional Court in Pristina.
