Once again, complaints by one of the candidates for handling the case by the judiciary are pending a Constitutional Court ruling.
The Prosecutorial Council has said they expect more efficiency in handling the case, considering the importance of position.
Kosovo Prosecutorial Council (KPK) finally expects the Office of President of the Republic of Kosovo to carry out this constitutional obligation and the prosecutorial system to have the chief state prosecutor at the helm of the State Prosecutor's institution, with full legal and constitutional competencies. Knowing the importance of this position, we inform you that we are also in expectation of the Constitutional Court, which must speed up in the definition of the complaint made for the second time in this institution.
Consequently, delay in decreeing Chief State Prosecutor, Mr. Blerim Isufaj, it is unnecessary and in this regard we have demanded that the decree be made as soon as possible by the country's president, Mrs. Vjosa Osmani, who is guarantor of the functioning of the country's institutions, in order to have full functionality and ensure implementation of the Constitution of the Republic of Kosovo”, have said KKP.
In accordance with this institution, assigning the chief state prosecutor's task to be a temporary solution and that continuing this taskary position could bring uncertainty to this institution's immediate planning.
“Also, the KKP, has stated many times to the media and the public that, assigning the State Chief Prosecutor's Task Officer to the task force, was a temporary solution and the exercise of duties by the chief state prosecutor by long-term task manager could bring uncertainty to medium- and long-term planning for the prosecutorial institutions and for the state of Kosovo itself in the field of rule of law.
Therefore, the Prosecutorial Council hopes very much that the prosecutorial system will soon have its owner at the time when it most needs the state of Kosovo, which is fighting so much for law rights and rule. ”
That Kosovo's judicial system would have to address priority cases when dealing with important positions in institutions, they also say at the Kosovo Institute for Justice.
And what I believe is that this process of appointing the chief prosecutor has taught us, and it has taught the Constitutional Court a lesson, is that the Constitutional Court would have to be that in cases where we're dealing with high-ranking appointments such as the State Prosecutor, or the Supreme Court president, then not let this process go to regular court courts, because they're taking a long time, Ehat Miftaraj said.
Until, from the Foll Movement, they said delays in returning the response to a candidate are unnecessary and harming the prosecutorial system.
I definitely consider that there is no very strong reason for procrastination, of this process, and as we have said in the past that the president should give an epilogue to this process, fail to return to zero, or with the approval of this candidate”, Medale Demolli has said.
On April 8th 2022, the presidency was submitted to the proposal by the Kosovo Prosecutorial Council for the appointment of Blerim Isufaj in the position left with task guides, from the end of Alexander Lumez's mandate.
However, Isufaj's name has not been decreed by President Osmani, who for this matter has not returned but has repeatedly repeated their expectations for completing the processes that are close to the courts, ahead of a decision.
His selection process, in addition to having been contested by civil society organisations -- by one of the candidates, Albanian Fazliu -- has also been followed in legal ways, with classes that for the second time currently at the Constitutional Court. /Dukagini/
