On June 27th, 2023 has become 7 years and 5 months and 27 days since current Minister of Internal Affairs Jedal Svecla, along with Social Democrat Party Chairman Dardan Moliqa and others are accused of hooliganism and other works during a protest held in 2013.

So, after 10 years or 3 grand of 652 days from the day they are accused of committing criminal acts, the subject is ending without epilogue after the absolute prescribing of the works that current officials and former members of the Vetevendosje Movement are currently at the helm of executive power, including Minister Svechla.

The first time the indictment was issued on August 10, 2021 after Svecla and the others were invited to court to face charges involving 2013.

Based on Article 412 with paragraph 3 and 4 of the Penal Code, penalty for the case appears to be fined from 200 to 10 thousand euros, as well as imprisonment to 5 years. The relative foreword of these works takes place after five years as the absolute prescription takes place after ten years of criminal activity.

The “Justice Vow” has sent information requests to the Foundation Court in Pristina concerning the history of prosecution of the criminal case to Minister Svecla and others. Information has been requested that after the trial was held at the Court how many hearings have been scheduled for this case, on which dates, how many of them were held, and how many failed to be held. The reasons for the failure of scheduled sessions have also been requested.

But until the publication of this article, the Court has not sent the required clarifications.

Over 7 years after the indictment, no session

The first session of Jelal Svecla and others was scheduled after two thousand 706 days after the indictment was filed against them for committing hooligan acts and other criminal acts. So the first initial review appointed by Judge Erroll Gashi was on 10 rounds 2021, exactly 8 years and 1 month 18 days after June 23, 2013. But Jelal Svechla had missed her. This session and others had failed because of the lack of indictees, who have been missing each other at sessions.

277 days after the first failure, the next session was scheduled, exactly on February 3, 2022. As on August 10, 2021, the second time the trial of Svechla and others had failed. Again, Svechla and another accused had been missing. That day, Judge Gashi had issued a warrant for strong conduct after having evidence that the accused had been regularly invited.

Unlike the other two times, the third time, 400 days after the first failure, Jelal Svechla had arrived in court at the session scheduled for June 6th 2022. Yet again, the session failed after Dardan Moliq and five others were missing.

On August 1, 2022, Jelal Svechla. It was marking the third absence in the fourth failure of the trial process against him and others for hooliganism and other criminal acts. Svechla had argued she was missing the hearing because of developments in northern Kosovo. In this session, Judge Gashi had announced that he would isolate himself to indictees Xhelal Svchla, Dardan Moliqaj, Edsim Macestena, Pajtim Havolli, Agron Kabashi, Egzon Azemi, Demajer Krasniqi, Nol Nushi and Akrem Hoxha. The court process had only continued with regard to the accused Bekim Shkodra, Sami Avdiu and Besnik Celja, isolating themselves from the high mentioned with a new number of subjects due to lack of hearing.

On March 9, 2023, the hearing had again failed. Although present was Svechla, it was this time that Dardan Moliqaj and four other indictees were missing.

On March 29th of this year, Jelal Svechla and the other six were missing again, while the other six were present, Egzon Ademi, Payrim Demaj, and Africa Hoxha;

The initial review had continued against indictees Egon Amamim Demaj and Afrem Hoxha after Judge Gashi had again made a decision to single out the procedure against them, since the opening word was also given and was passed to the stage of opposition to evidence and indictment in the 30-day term.

Therefore, the trial against the accused, Minister Jedal Svecla, as well as Dardan Moliqaj, Pajtim Haval, Arsim Maqasten Kabashi, Fraser Krasniqi and Nol Nushi, had been isolated and had taken a new number as criminal against them.

In this case where 13 people were accused, the trial against them is followed by three separate criminal subjects, and all of this as a result of the once absence of the spin charged in separate court examinations.

Also in this case against Besnik Qeyal, Bekim Shkodra, and Sami Avdiu had become the isolation of the criminal procedure on August 2, 2022. Qalajt and Shkodra for criminal work “Share in crowds performing criminal acts and hooliganism” had been tried in one and a half years in prison.

Meanwhile, separate court examinations of Bekim Shkodra for criminal work still continue “Attack the official person” and Sami Avdiu for the criminal act “Crowd participation performing criminal acts and hooliganism”.

The judge had issued a warrant to force Svechla to the media and said something else.

At the February 3rd session of 2022 after the hearing had failed in the absence of indictee Jalal Svecla and Agron Kabashi, the case had issued a warrant for strong conduct because there was evidence that the same were regularly invited but had not been tried.

Regarding the issue of this ordinance, the court judge had reacted to other media online with the claim that such an ordinance had not been issued, but the editorial of the “Law of Justice: through proclibal and audioinciation proved that for the accused who was invited and did not present in the hearing would issue such an ordinance.

The “Piles, who have been invited in a regular manner and are not presented at the session, the court will issue the ordinance for forced conduct”, said in the session report.

On this matter through a 266 “Justice Vow” report had clarified in detail the issue of issuance or not the ordinance for the strong conduct of Minister Svecla.

By the 27th June 2014, the Constitutional Prosecutor in Pristina had accepted criminal outcry by Kosovo Police against suspects Dardan Molliq, Jelal Svecla, Arsim Maqastena, Bekim Shkodra etc, for criminal work “Attacking the official person as well as for criminal work “the annihilation or damage to property” and as of June 30th, Kosovo Police had also handed over an additional criminal charge now for criminal work “Pegim of the official person during the performance of official tasks”, as well as for criminal work “

On the basis of this indictment on March 14, 2014 The Constitutional Prosecutor in Pristina had filed an indictment against Dardan Molyqaj, Arsim Maqasten, Pajtim Havoli, Agron Kabashi, Egzon Azemi, Pajtim Demaj, Jelal Svecla, Fraser Krasniqi, Nol Nushi, Bekim Shkodra, Afrem Hoxha, Sami Avdiu and Besnik Kemal with the exhibition prosecutor of Sebahat Hoxha;

Dardan Molyqaj, Arsim Maqasten, Pajtim Havolli, Agron Kabashi, Egzon Azemi, agrees with Demaj, Jelal Svecla, Fraser Krasniqi, Nol Nushi, Bekim Shkodra, Afrem Hoxha, Sami Avdiu, and Celaj are tasked with the criminal work by any other than “Pjejeser in the crowd that performs criminal work and hooliganism” from Article 412 on November 3th of the Republic Penal Code of Kosovo <0).

Meanwhile, for Bekim Shkodra, the prosecution had charged him with criminal work “Attack the official person while performing official task” by Article 410 paragraph 2 of KPRK;

In the indictment filed on March 14, 2014, it is said that on June 27, 2013, on the “route, Teresa” during the protest through violent and hooligan acts of the accused had thrown stones, color, glass spheres, bottles, pirotechnic tools where police officials Rifat Gel Syla, Agim Xheli, the Hyseni Union, in addition to their actions, had damaged official uniforms and police equipment and thus damaged the two types of cars <2x> Mitsubish Pajero” and the other “Taurg” owned by the Government of Kosovo, as well as two other “cars Golf V” these property of the Kosovo Police, so with these actions of accused Dardan Molliqaj, Arsim Maqasten, Merim Havoli, Agron Kabashi, Egzon Azemi, Pacim Demaj, Xhelal Svecla, Frasher Krasniqi, Nol Nushi, Bekim Shkodra, Afrem Hoxha, Sami Avdiu and Cemeli had performed criminal work <x8Pjejejeser in the crowd that carried out criminal work, and humigism<9 from 412 in connection with CPRS.

Meanwhile, at the second point of the device of this indictment, Bekim Shkodra said on June 27, 2014, on the “Mother Teresa” had physically attacked the injured Rifat Gecin by kicking his right foot in case he had caused slight bodily injury, and with these actions Shkodra was also accused of criminal work “Attack the official person while performing official task” by Article 410 paragraph 2 of KPRK;

As evidence which is listed in the high-emphasized indictment, among other things, are video-incipulations at 5 CDs provided by electronic media, damaged medical reports Selatin Sheholli, Rifat Geci, Bashkim Hysni and Agim Rooster, photo finalum with photos from the site of the event;

In the videos provided as material evidence according to the indictment, nol Nusshi and Fraser Krasniqi are said to be clearly seen invasive actions of accused Nol Nuschi and Frasher Krasniqi by damaging the Kosovo Government car, while accused Egzon Azemi, Agron Kabashi, Pajtim Havoli, Demaj are seen throwing color, while accused Dardan Moliqaj physically attacking police officials;

A reason for the indictment is said to be in the case of the reportedly provided photos by accused Jalal Svecla throwing stones at Kosovo Government cars, meanwhile for accused Bekim Shkodra the same testimony by witness Rifat Geci proves the commission of criminal work “Attack the official person” ;

Meanwhile for incriminating actions of the other accused, Arsim Maqasten regarding criminal activity “The attack on the official person” is confirmed by the identification that had made the same police official Berat Haradinaj;

Also for the actions of accused Besnik Celaj from the videos assured clearly that during the entire protest he had been aggressive by attacking police officials on what he had committed criminal work “Crowd participation performing criminal acts and hooliganism”. /Betimy for Justice
