Sentenced to 11 years in prison one accused of grave murder in Lipjan, one acquitted of prosecution

The Constitutional Court in Pristina has pronounced a conviction trial against accused Besnik Bedrol, condemning him to a unique 11-year sentence in prison in connection with the charge that in February 2015, at the restaurant “Agoni” in the village of Banula in Lipjan, has deprived the late U.D.'s life now. The accused Bajram Bedrol, however, was acquitted of the prosecution.

The prosecution against the two indictees was announced Thursday by the chairman of the court, Dandrim Arren, reports “Justice bet”.

According to the trial, accused Besnik Bedrolli is found guilty and by the evidence administered in this trial and remarks in the two preliminary decisions of the Court of Appeals have concluded that for criminal work by device 1, he is sentenced to prison for 10 years. For criminal work, however, the device 2 for illegal possession is sentenced to prison for a length of 1 year and 4 months.

To accused Besnik Bedrol, the court pronounced a unique prison sentence of 11 years, which the sentence will be executed in the 15 days after the integrity of the act.

The same will be accounted for in custody by February 15th 2015.

The court also seizes the weapon, with which criminal acts were committed.

The Besnik accused is obliged to pay the judicial paushal in the name of procedure in the amount of 200 euros, while for the compensation of crime victims, at 50 euros, all in the 15-day term following the integrity of this act.

As for accused Bajram Bedrol, of the evidence administered during the trial and remarks and conclusions of the Court of Appeals, the court has not confirmed that the same contribution was made to the execution of the late man's murder. Hence, the same action sets him free from accusation.

Similarly, the court has failed to prove with any evidence that the accused committed the criminal act of “retaining or unauthorized possession of weapons”.

As for the actions of now accused Bajram and Bedri Bedroli, in terms of minor bodily injuries inflicted on the injured Erroll Qyqalla and Skender Ademi, the court finds that these incriminating acts have now been written.

Those injured in terms of property-juridical demand are directed to regular legal-civil disputes.

Otherwise, twice the case was established, the first time the Constitutional Court in Pristina on November 27, 2018, accused Besnik Bedrol, had sentenced him to 14 years and 6 months in prison, while for illegal weapons, to 1 year in prison. To him, the court had pronounced a unique sentence of 15 years in effective prison.

While accused Bajram Bedroli, for help in carrying out criminal work “grave murder”, had been sentenced to 9 years and 6 months in prison, while for illegal weapons had been sentenced to 1 year imprisonment, but this court had pronounced a unique sentence of 10 years in prison.

However, the Court of Appeals had turned the case into retrial, cancelling the act of first - degree judgment.

After returning to the retrial, the Constitutional Court in Pristina on July 24, 2020, accused Besnik Bedroli of criminal activity “grave murder” had sentenced him to 11 years in prison, while for the criminal work of “Arterisation without permission” to one and a half years in prison. The same, the court has pronounced it a unique prison sentence of 12 years.

For accused Bajram Bedrol, the court has made rescinding of the criminal act by “grave murder” conducted in co-ordination, in criminal work “The slight bodily execution”, at the harm of the Erroll Qyqala and Skender Ademi.

“We have not found that Bajram Bedroll has committed the criminal offense of the 179 heavy murder, paragraph 1 concerning KPRK's paragraph 1.5, in co-ordination, by Article 31. In view of Article 360, the court has found that the same was committed in the criminal work “The slight bodily launch of”, from Article 188, paragraph 2 of KPRK, at the expense of the injured Erroll Qyqalla and Skender Ademi”, Judge Krasniqi-Jashnica had said.

The accused Bajram Bedrol, for carrying out the criminal act “light bodily access”, from Article 188, paragraph 2 of KPRK, was pronounced a prison sentence of 2 years and 10 months. Following the complaint exercised by the Constitutional Prosecutor in Pristina, the Court of Appeals, with the ruling of March 11th, 2021, has cancelled the first degree ruling and the subject has turned it into retrial.

That decision, Apeli has argued that the first degree decision is involved in essential violation of procedure provisions, the same is not compiled in accordance with provisions of Article 370, par. 7 KPPK, as well as due to the wrong and incomplete confirmation of the actual situation.

Otherwise, according to the indictment set up on October 12, 2015, it is claimed that Besnik Bedrol and Bajram Bedrol, on February 14, 2015, at the restaurant “Agon” in the village of Banula in Lipjan after a dispute between them, in co-ordination has now deprived the deceased W. D.

According to the indictment, the same was originally spoken of and then attacked by the late D. and to the injured Errol Qyqalla and Skender Ademi by strong means, the deceased had used his weapon to avoid the attack, but defendant Besnik Bedrol, with his gun about a meter at about a foot, fired at D. Four times and the wounds taken, he died at the scene, and the defendants fled from the scene.

With these actions, the prosecution charged the accused with the criminal act of “heavy murder” by Article 179 of the Penal Code and for “keep ownership, control or unauthorized possession of weapons” by Article 374 of the Penal Code.
