By means of these SPS predecessors, it requires that the detention measure for Thaci and Veselin be continued.
According to the SPS since the latest decision of this panel on April 17th 2023, there has been no change in the circumstances deserving of deviation from that decision, adding that the continued progress of judgment and other important developments will continue to provide Thaj and Wessel further access to information about sensitive witnesses and the issue against them and that this, according to them, demonstrates the necessity and reasonableness of detention.
In addition, Article 4150) requires the belief that the detained person committed a crime within the jurisdiction of the DPS, which according to Z. The SP remains suspicious that Thaci and Wessel have done so.
According to them, there is doubt that Thaci and Wessel are responsible for crimes against humanity and war crimes. And it is also said that the three reasons under Article 41ʹ6) that justify the ban are: 1) the risk of escape; 2) possible obstruction; and 3) the risk of additional crimes, which these, according to Z. The SP's are real opportunities.
The start of the trial reportedly leads to the risk of fleeing to an even higher level, as Thaci and Wessel are already seeing evidence against them are constantly entering the record.
Similarly, the combination of continuing to get a fuller knowledge of the case against them is said, given the fact that guilty evidence enters into the chip and is being informed via Mustafa case of the real possibility of a long sentence, raises the risk according to Z. Thaci's SP and Wessel's to leave.
The SPS states Thaci and Wessel continue to pose risks for obstructing the procedure. According to them, this Panel has in advance found that the risk that Thaci and Wessel could prevent the management of the procedure in DrsK and that the Specialised Prosecutor's Office thinks such a danger continues to exist.
Also reportedly, the SPS thinks there is still a risk of committing other crimes, and since this panel has ascertained such a danger in advance, they say there is no change in circumstances from the recent findings to the issue, which includes the general climate of witness intimidation in connection with KLA crimes.
So considering these same and additional factors, Thaci and Wessel's ban, according to Z. The SP continues to be reasonable.
Otherwise, the Specialised Prosecutor's Office, on September 30th, 2022, has handed over the confirmed amended indictment against Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, which consists of ten points of charges, where the latter are charged with war crimes and crimes against humanity. /Being fair
