With great regret, I have announced that after the silence of AugustI and the depletion of all other options for reviewing the decision by the Minister of AugustI today, in consultation with my attorney, I have submitted to the Constitutional Court in Pristina, the Department of Administration Affairs PADI for the annulment of the administrative act and his replacement on trial.
December 2022 MASTI announced the 2022 scientist award competition, where the exhibition said that “this year will be divided 3 (tri) prices for “Year scientist, 2022 scientist and 3 (three) awards for “New scientist of the year, young 2022 scientist”.
In this competition I have applied, delivering all relevant evidence within the legal deadline. The applications of all candidates have been reviewed by two troops appointed by the Minister of AugustI -- under the advice of relevant science fields, and the Ministry's Scientific Council.
Under the TIK field council (which included my application), led by Prof. Dr. Arbnor Pajazit recommended me as the candidate for the award award of 2022 scientist.
Even the Scientific Council ON February 2, 2023 meeting, led by Prof. Dr. Vjollca Comeon recommended me as the first on a list of 3 (three) scientists for the 2022 scientist award, as the competition required 3 (three) scientists for award - giving.
After an extension of the process, nearly six months old, the Minister of August 9th on June makes the decision to choose the second candidate from the 3rd (three) recommendations, even though the exhibition competition says 3 (tri) will split! Through email and protocol letter I have asked the Minister of AugustI to reconsider her decision.
All this evidence, which I have received after my request to access public documents, I have attached my indictment, summarized on 7 pages.
The silence of 10 days from August, and thus, only the courts are exhausted, because the arbitrary decision of the Minister of August “is an illegal administrative act, because:
• It's been taken against material rights (the Law for Scientific Activity, National Science Programme and Public Competition),
• It's beyond legal authorization limits by exercising power “discretionary”, and
• It is contrary to the principle of legitimacy defined in Article 4 of the Law for General Administrative Procedure and other requirements of this law pertaining to the form and content of the administrative act. ”
I am very convinced that the results (tests) presented in this scientific work (suit), will be convincing for “revier” (trial) to be approved as truth because the search for truth is an integral part of science!
