The findings of this report say KEK has signed Framework Contrast, with the Slovenian company “Holding Sloveneske electricity d.o. O” which has not had license known in Kosovo.
This KEK action conflicts with some of the provisions of the Law for Energy Regulatory.
“KEK has signed Framework Agreements with companies which are not licensed in Kosovo, however, is not recognised by the license issued by the countries, according to the principle of reciprocity. Given this finding, KEK has not acted in agreement with Article 28, par.1 and par. 2 and Article 30, par.1 to Law on Energy Regulatory, Article 32, par.3 to Electricity Law, Article 2, par. 2.1.2, 2.1.3 and 2.1.6 of the market rules, Article 8, par. 1 to Procedure for Energy Marketing Electric”, says the report.

According to the report, based on legislation in effect, the activity of electricity supply and trade can only be exercised by license issued by Z. THREE for legal subjects that are registered in Kosovo, including the possibility that, according to the principle of reciprocity, these activities will be allowed even without ER licenses.
“The ZRRE has analysed all the files that have signed a framework contract with KEK, and estimates that the process pre-qualification for the procurement power activity has not been carried out according to the legal provisions in force, with KEK's cçrast signed more commercial framework contracts that do not have or are recognized license in Kosovo <ex1>, the report said.
This contract, along with seven other contracts, was signed in December 2018.
The other seven contracts according to the report had been granted licenses. Four of them were companies from Kosovo, three from Albania, and one from Slovenia, which was the only one that had no license. /Dukagini
