The court has ordered the Parliament and Government, which no further than July 15, 2023, to take the necessary actions to meet and change this law. At the same time, these provisions will be abolished on July 15th, 2023. In the event that the Government does not respect this date, citizens will be the ones to suffer the most. They will be forced to pay lawyers to file charges in the Constitutional Court to enjoy the right of contributing pension under the Constitutional Court's ruling. Because procedure spending will be generated, this situation could also damage the budget of the Republic of Kosovo.
But, the government has planned that the bill aimed at addressing the demands of the Constitutional Court, only in Government, should I welcome it on July 30, 2023.
The deadline set by the Government conflicts with the demands of the Constitutional Court's act. In Kosovo's constitutional system, the Constitutional Court's judgments are equivalent to the constitutional rate. Thus, this government action is contrary to the Constitution of the Republic of Kosovo.
The actions needed to address the requirements on the basis of the indictment imply the introduction of the new pension scheme bill to 15 July 2023 rather than the adoption of the draft law in Government by 15 days late. Given that Kosovo's Assembly goes on vacation at the end of July and the start of the Parliament's work starts on the second Monday of September, then the final adoption of the bill will be made late for several months.
The IKD expresses deep concern over the irresponsability of the Government of Kosovo over its failure to comply with the full demands posed by the Act in case no. Euro190/19. Delays in adopting this bill by the Government violate the rights of thousands of Kosovo pensioners and submit to failing to implement the Constitutional Court's act of prejudice.
The IKD, requires that, in the case of the adoption of the draft law in Government, the minimum standards of public participation in public consultations with citizens and interest groups are respected, and then such a bill is adopted by accelerated procedure in the Kosovo Assembly, so that this law can be enacted no later than July 15, 2023.
