What is said in the draft of former management team that Kosovo has refused

During the meeting, on May 2nd, an management team, consisting of four members of the Serb community, had introduced the draft status state for forming association, but was opposed by Kurti.

According to Kurti, there is a desire for a Republic of Kosovo and this wish has written this statute, stressing that the document, as such, is currently incompatible with Kosovo's constitutionality.

The draft has 67 articles and is divided into nine chapters, such as general provisions, community issues, organisational structures, membership in association, and relations between member municipalities, assets and incomes, direct decision-making forms, changes in the Constitution of Association, break-up of Association and transitional and final provisions.

It says that association will be a special form of organisation, founded for the purpose of protecting human and minority rights living in municipalities that are part of the Association, Telegrafi writes.

The association to do so will register voters, keep birth records, marriages and deaths, make a full summary in the areas of economic development, education, health care, social welfare.

The association, through its organs, will pass decisions on the Assembly and regulations, oversee the implementation of laws, regulate elections, conduct the reorganization and functioning of organs, agencies, public enterprises, conduct the collection and processing of statistical data, propose referenda, decide on financial borrowing, adopt the annual budget and balance, establish organisations, agencies, companies and public institutions, funds, financial institutions, and oversee their work.

Article 7: The city of northern Mitrovica will be the administrative centre of the Community and within will be located in the community's organ area.

Article 8: The community will establish its symbols together with the way they are used. Community symbols will be anthem, flag and coating. The Parliament's decision to symbols of the Community will be adopted with the majority of votes of all advisers.

Article 11: Under the competencies defined with this station, the Community will create new ones and manage and conduct full supervision over existing institutions, the founder of which is the Republic of Serbia in the field of education, the standards of students and students, science, culture, physical culture, health protection, social care and other areas of the Statut.

The Assembly of Association can announce referendums at its own initiative on matters within its competencies, while it is obliged to announce the referendum at the request of 10 per cent of voters who reside in the territory of the association's member communities.

Article 31: The appointment of County Police Commander. The community will appoint the regional police commander for municipalities: Northern Mitrovica, Zvecan, Zubin Potok and Leposaviq.

Article 54: Natural resources (sources of coal, metal and non-metal trees, water, water canals, their resources, underground and geothermal resources, etc.) located on community territory

Member municipalities are managed by the Community, Stituti and the Assembly.

Assets of common interest (agricultural land, forest and forest land, land water, objects water, supply and distribution networks, protected natural resources, cultural goods, etc.) located on the territory of the Community Member Communities will be managed by the Community, Statuti and the Parliament's decisions.

Also, assets in general public use (public roads, railways, tunnels, bridges and other structures that make up integral and functional parts of public roads, railways, tunnels, bridges, streets, public parks, and so on) located on the territory of the Community Member Communities will be managed by the Community, the Status and the decisions of the Assembly.

The association generates revenues based on the participation of member municipalities, from services provided by Association, Tax and tariffs, as well as from funds allocated from Serbia's budget.

Otherwise, the European Union's high representative for foreign policy has stated that the draft association state presented in Brussels is not final, but will only serve as the starting point for further negotiations.

He stressed that the parties should engage in trust and be ready for compromises.

While Vucic considers that for the key “issue” of forming the Association of Serb majority municipalities, it is clear that “Pristina does not want to meet its ten-year obligation before”.

For me it was clear... The EU came out with its proposal, I accepted it, Pristina rejected”, Vuciq said after the meeting.

He added that he hopes that by the next round at the technical level, there will be a reaction from others that could “condition on changing such positions”.

Kosovo and Serbia have reached agreement on forming association in 2013, while its principles are agreed on in 2015.

The Constitutional Court of Kosovo has concluded that the same year that some of these principles are not in line with the spirit of the Constitution, but has said that if they are harmonised, the association could be formed.
