Michael Doyle, spokesperson for Kosovo Specialised Chambers ( In The Hague, through week-long briefing of the DHSK for media on Thursday, it has stated that the first witness in Thaci case and others has testified largely at private hearings, but that this, in the part of the judge, is set to protect the identity and security of witnesses or victims.
According to him, the first witness called by the Prosecutor, in the trial against Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, testified this week with protective measures, mainly at private hearings, and that she was questioned by the prosecution and were also asked questions by the defence teams.
The same, through this information, has said that all pre-DPS judgments are public, yet judges sometimes decide to conduct part of the trial hearing in what is known as a private session or to edit specific information to protect the identity and safety of witnesses or victims.
The decision to make private hearings to protect witnesses is carefully considered by judges, case by case. The judges ensure that there is balance between the need for witness protection and the rights of the accused. For example, even when witness testimony is not public, the accused's lawyers still have the right to question their witness”, Doyle said.
Meanwhile, concerning Peter Shala's case, he has informed that the court ordered on April 6th the continuation of the defendant's detention, which, according to him, the court found the risk of Shala continuing to prevent proceedings or commit other crimes.
The court's “Trup also found that detention follows to be necessary and reasonable, because these risks cannot be reduced enough through the implementation of reasonable alternative measures, but only through the framework of monitoring communications that is implemented in the DKSC detention facility”, he said.
Otherwise, Kosovo Specialised Chambers in The Hague every Thursday at 14:30, via online platform “Zoom” hold weekly information offering updated information on recent developments regarding judicial procedures and activities in this court. /Betimy for Justice
