Special Court Reports UN, but Not Kosovo State

Although founded by the Parliament of the Republic of Kosovo, the Special Court reports its work to the UN in New York, its Secretary General Antonio Guterres and through it to the Security Council, as well as member states, where Serbia is part of. The report will be discussed at the Security Council meeting [...]

The UN does not recognise the state of Kosovo, nor does its Secretary General nor the Security Council, due to opposition from Russia and China, which continue to be close allies of Serbia.

While U The NMIC and EULEX regularly report to the UN because they also have a mandate from this organisation, remains puzzle and strange why the Kosovo Special Court, which is said to be part of Kosovo's justice system, reports to an organisation that does not recognise the Republic of Kosovo and because it is not its member continues to face various obstacles and difficulties in the international arena.

Through the UN and its secretary, the Special Court of the Republic of Kosovo actually indirectly reports to Serbia because it is a UN member state and each member is sent to the Secretary Guterres' reports.

In the official UN report on Kosovo, dated April 5, 2023, which the paper “has provided. The New Age”, on annex 2, Special Court reports its activity for September 16, 2022 to March 18, 2023. The report writes that it belongs to both the Specialised Chambers and the Specialised Prosecutor's Office - judges and prosecutors.

No start of the trial against former KLA leaders, Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, is included, but for this process, the Special Court will report to the UN with the next document in a few months.

However, in the case of former KLA political elites, reports of what preparations are being made for the start of the judicial process and all prosecution charges against them are counted.

The first sentence in the document says that the Special Court has achieved huge achievements and continues with the announcement of the sentence of the first KLA member, Sali Mustafes, to 26 years in prison.

Next, the Special Court continues to confess to the UN with other information, such as the performance of cases against Peter Shala, Hysni Gucatit and Nasim Haradinaj.

Then they talk about visits by Special Court President Ekaterina Trendafilova to Kosovo from 20 April to 23 April last year, during which she has talked to civil society, media, law students, Kosovo Justice Minister, but does not mention that Albulen Hadziu is named.

This minister is the only Kosovo state official that the Bulgarian judge has met during the visit to Pristina, while the document says she has had separate meetings with many internationals in Kosovo, including all ambassadors of EU states in our country, chief of the EU Office, the chief of EULEX, UNMIK, etc., etc., but not even Glauk Konjufca, Kosovo Assembly Chairman who has founded the Special Court, or other Kosovo Republic officials.

Of course, the head of The Hague-based Court, which has no mark of the state of Kosovo (flamm, coating, republic, etc) in its facility, has also met the UNMIK chief in Kosovo and has announced how things are working on judicial processes there.

The report also reports many meetings at Special Court headquarters and abroad with various EU representatives and member states and other sponsor states, including those that do not even recognise Kosovo's passport, leaves its independence, such as Spain.

The other weird thing in the UN report that actually prepares U n NMIC in Kosovo, is that a particular part is called: Northern Kosovo, which is widely talking about the overall situation, talks with Belgrade and security in this part of the Republic of Kosovo.

Special Court reports, according to newspaper research, have been made over and over again.

Kosovo's representative at the meeting in New York on Thursday 27 April remains to be seen what position he will take on this scandal.
