The Ministry of Foreign Affairs and Diaspore (MPJD), respectively, has eventually expelled diplomat Albert Prenkaj from the Civil Service.
The decision on his dismissal has been made against the Pristina Constitutional Court, on March 20th, approved by Albert Prenkaj's request against the Independent Council of Kosovo Civil Service Supervisor.
Under the ruling, the Court's decision has been annulled by the Independent Kosovo Civil Service Supervisor Council, and the issue must be returned to review and reinstatement.
But the MPJD has not taken the decision into account, not cancelling the suspension decision, but, rather, Prenkaj has been excluded.
Portal Dukajini has secured the decision by which Prenkaj is expelled.
“Albert Prenkaj at work Director of the U.S. Department, Secretary-General of the Ministry of Foreign Affairs and Diasposor/Responsor direct with the date 28.03.23, has initiated the disciplinary procedure with the argument that: “with a date of 28.03.2023, in the quality of direct supervisory officership for the U.S. Department, taking into account the duties and responsibilities, after examining the causes, the circumstances of committing violations, consequences, consequences, the prespecies, the pronunciation of precautions, and the eligibility, I conspired to the 46, 2,21, 163, 483, 33, 33/10; and 33th Street, 33th Street. 06/L -114 for Public Officials, as well as subs 4 and 5 (paragraph 1.1.1 and paragraph 2), Article...”, says the verdict.

In his speech to the disciplinary commission, which has provided Portal Dukajni, Prenkaj has said the MPJD is violating the country's Constitution.
This is happening today and in general in the ministry is an unconstitutional enterprise that violates fundamental rights such as Article 23. Human dignity; Article 26. right of personal integrity; Article 29. Freedom and Security Right; Article 43. Freedom of assembly; Article 44 freedom of association; Article 49. The right to work and practice”, he said.
He has also said that Behar Isma, was appointed by Minister Donika Grovala illegally and that he is exercising his position of deputy secretary-general illegally.
He has said that apart from Isma, Gervala has also issued documents illegally, which he says is subject to state organ treatments.
“Over this group, led by Minister Gervalla Schwarz himself, will have continued investigations, years-based formalities for the financial damages that have been inflicted on the Ministry and the constant legal breach during decision-making”, he has said.
Prenkaj has said that the disciplinary Commission has no legal power to make decisions.
“Besim Berisha, the leader, Hyzri Bunjaku and Katarina Krqku, a member, with the processor Elmas Shufta from NMBNj, let me remind you as I stressed that this group today has no legal support, since it is founded with the signing of the person who illegally holds the position of the deputy secretary general. So this group called the Disciplinary Commission has no legal skills to undertake activities according to the legal rate in power, and as such there is no judicial power to make a decision”, he said.
Prenkaj was suspended and now fired with the reasoning that he has protested MPJD's. But according to him, this is not against the legal but righteous which the law guarantees.
His claims had confirmed the Constitutional Court, but this did not affect his return to work; rather, he was expelled.
