Miftarian: Kurti's intervention in Nagip Krasniqi case was flagrant

Kosovo Institute for Justice Director Ehat Miftaraj estimates that the prime minister's reaction, Albin Kurti, to Chief Special Prosecutor Blerim Isufaj after KEK Director Nagip Krasniqi's arrest is direct intervention in justice. This really cannot be called anything other than direct intervention of Prime Minister Kurti Government [...]

This could actually not be called anything other than direct intervention of the prime minister, Kurti Government in the independence of the justice and prosecutorial system of the Republic of Kosovo. Kosovo's constitution has made an iron division between executive, legislative and judicial power. The Republic of Kosovo promoting a parliamentary democracy with such a division of powers, embracing standards, international practices related to promoting the independence of the judiciary do not allow a politician, a minister, a prime minister, an MP to accept a chief prosecutor, prosecutor, judge or comment on the Constitutional Court's decisions, fair courts or prosecutorial decisions. This in a legal state, in a state like the Republic of Kosovo, simply the Constitution does not tolerate such an approach”, Miftaraj said.

According to Miftaw, however, chief prosecutor Isufaj must be prepared for even more serious intervention and attacks.

“In the first place I am telling the right, I don't have much trouble with Blerim Isufaj because he has agreed to be the prosecutor, the moment he has agreed to take over the post of chief Special Prosecutor, the same as such attacks by politics should also expect attacks by criminal groups that are far more dangerous than the prime minister's political statements. The chief prosecutor of the Special Prosecutor, every prosecutor should be ready for such sacrifices because ultimately the prosecutor's duty brings these. But I believe that more frustrated citizens should be citizens of Kosovo, more frustrated should be the public with such an approach of the prime minister, the government, who are not able to make the difference when and how they can comment on the decisions of courts and prosecutors”, he said in Tv 1.

Miftaraj further emphasises that Justice Minister Albulen Haxhiu has iron will to make positive changes to the system, but according to him “then this first part is being devalated by the second part by the actions of the Kurti Government, ministers or deputies”.
