The Council for Protection of Human Rights and Freedoms is praising that there is currently no legal basis that will compensate on the monthly basis for the alleged KLA victims, and therefore the Government of Kosovo cannot be charged with obligations that are not regulated by law.
This court on Thursday, April 6, 2023, has issued a verdict under which it obliges the former KLA commander to pay 207 thousand euros to the victims. Eight victims were involved at the court's order to make a injury.
But according to this court it has been found that, currently, Salih Mustafa does not own the means to make this payment, so it is expected that the appointment of an supervisory authority regarding the implementation of the requisition order, which will clearly determine Salih Mustaf's financial opportunities to pay the compensation.
KMDLNY response:
J EXPECIAL YKETE NOUK YOU CAN DEVELOP THE CENTURY TUI COMPENSOSE VICTIMS
Salih Mustafa, by the Special Court, with a no-cut ruling has been sentenced to 26 years in prison because of illegal murder, arbitrary detention and torture. Meanwhile, the same court, on Thursday, April 6, 2023, has made a decision that forces the former KLA commander to pay 207 thousand euros to the victims. Eight victims were involved at the court's order of injury. But according to this court, it has been found that Salih Mustafa currently does not own the means to make this payment, so the definition of an supervisory authority regarding the implementation of the requisition order, which will clearly determine Salih Mustaf's financial possibilities for paying the compensation, is expected. If there is no possibility that Salih Mustafa will damage the victims, as the court's option for the damage to the victims remains to take place from Kosovo's budget through the Ministry of Justice.
Long ago, the Special Court in The Hague was addressing the Ministry of Justice with several questions to clarify the way and mechanisms that compensate victims by expressing serious doubts about the willingness of Kosovo institutions to compensate the victims that recognise this status, especially up to the amount they would compensate for. Clearly, they were not satisfied with the response of this ministry, which, in its response, clarified that in Kosovo there is a Crime Victims Compensation Commission but that alleged victims cannot benefit any compensation under law in force because they are not included in the beneficiary categories under this law.
The Special Court in The Hague supports the threat of casualties in Law No. 04/L)054 P THROUGH AND DIRETH WISE, INVALIDE, V ETERINES, THE PARTERS of THE CLIRISM CURSOW, VICTIMAS CIVILEE AND FAMILY THEY
The Special Court's decision in The Hague has the wrong legal basis because this law does not mention the possibility that neither directly nor indirectly the damage to alleged victims caused by the Kosovo Liberation Army or compensation on monthly grounds as envisioned for other categories addressed by Law No. 04 /L -054.
Currently, there is no legal basis that will damage or compensate on a monthly basis the alleged victims of the KLA and, therefore, the Kosovo government cannot be charged with obligations that are not regulated by the Law, respectively. To execute the Special Court's decision, a legal basis must be established, as should experts from Kosovo be responsible for determining the amount of damage. Under Kosovo's laws, the execution of damage should be done through the completion process, while the Special Court does not have its completions, while it does not trust any institution in Kosovo, including the owner, so it requires that a supervisory authority be formed for the implementation of the ordinance for compensation.
The Special Court, with nothing to prove that it is Kosovo, answers with nothing and nothing to Kosovo's authority, nontransparent to the conspiracy of the authorities and the opinion of Kosovo and international, with a limited and degraded mandate for what had been created into a group of failed beneficiaries in Kosovo and other countries where they have worked, providing for themselves and the enormous benefits of Kosovo, not having any interest in dictating their work not to harm those arrested by keeping them for years in detention and detention, to make every reasonable time, and to execute any standards, and to establish for them that the institution has no part of justice, and that is, these are, in fact, and those are, in fact, and those are, in fact, of Kosovo's budgets, and they are, and they are, as they are, in fact, and they are, and they are, as they are, and they are, in fact, and they are, and they are, and they are, and they are, are, and they are, are, and they are, and they are, and they are, and they are, are, and they are, are, are, and they are, are, and they are These, like legal triggers, are in The Hague with one leg, while the other is in Ukraine or another where there is war and where they see tremendous profit opportunities. Don't be surprised if tomorrow the same Special Court will ask Kosovo to pay the winter holidays at St. Moric and summer ones in Dubai. Investigators, prosecutors and Dubai judges, law prostitution!
