KCPP instructs businesses not to use equipment from several companies from China and Russia sanctioned in Kosovo

The Public Procuration Regulatory Commission (KRPP) has instructed Kosovo businesses not to use the services and equipment of some companies that are destined for the origin of China and Russia.
According to the KCPP, the deployment of technical specifications by suppliers for pre-accession services and equipment at the US Act for Safe Networks is prohibited.
Dahua Technology Company, Hikvision Digital Technology Company, Huawei Technology Company, AO Kaspersky Lab, Z. TE Corporation and Hytera Communications Corporation are the companies that provide these services that are prohibited by the CRPP.
This authority stresses that specifics involving national security should be taken into account during the technical description.

Paragraph applications 19.7, 19.8 and 19.9 of Rule No. 01-2022 for Public Procurement
Public Procurement Regulatory Commission (KRPP) with recent changes to the Order No. 01-2022 for Public Procurement, which entered into force on November 01st 2022, has made significant updates to meet and clarify the Public Procurement Law provisions and follow recent developments in the public procurement sector. One of the important updates of the regulation is the inclusion of rules on the descriptions of technical proficiency in the field of information technology and telecommunications, which rules are in place of increased cyber security and compliance with international developments in this area. Rules on descriptions of technical succincts in the field of information technology and telecommunications are included in No. 01-2022 for Public Procurement, Article 19 technicalizations and paragraphs as follows:
19,7 In describing technical specifications for work, supplies, or services required in the field of information technology and telecommunications, the AK should prevent technical descriptions that: a) specify equipment, services and suspicious IT producers and telecommunications; b) pose dangers to the country's cyber security and critical infrastructure; and c) pose risks to national security.
19.8 For paragraph 19.7 application. The matching authorities must make sure that the equipment, services and producers specified do not belong to the countries (states) for which the Government of Kosovo has imposed sanctions on import/export, or countries, products, services and supplies are considered incredible by any of the organisations/nations, such as: European Union, United States of America, NATO, OECD or the European Free Trade Association.
19,9 In any case, the AK in addition to preparing technical specifications, paragraphs 19.7 and 19.8 should be taken into account and applied even during the bidding assessment phase and selecting of contractors. And if the supplier, the manufacturer, the service (including under supplies/services) involved in the offer belongs to definitions according to the 19.7 or 19.8 of this regulation, the AK should automatically exclude from competition.
For the fulfillment of the covenants which flow from the highest point of view, The CRPP directs that, based on reference and practices of states and organisations listed in Article 19.8, that they are forbidden to establish technical specifications, and therefore procurements from suppliers, goods and services included according to the list of equipment and services covered by Article 2 of the Act for the Security Networks of the United States.
The ban on equipment produced by the following companies, including telecommunications services, video surveillance or provided by such a subject or using such devices, is:
