A deadline for decision-making by Constitution for the Law of Salaries

The Constitutional Court is proceeding with the ombudsman's request for assessing the constitutionality of the Law on Salaries. After 104 complaints received by various public sector subjects, the Ombudsman sent to the Constitutional Court, the Law for the Salaries in the Public Sector, which had entered into force on February 5, 2023.

This query is currently being processed. The court does not have any constitutional-legal deadline for decision-making in this case. Like any other request put forward by the institutions, the Court is also addressing this case with the seriousness and higher dedication”, the Constitutional Court has said in a written response.
And in applying for the interpretation of the constitutionality of the controversial law, which the ombudsman has sent to the Constitutional on 7 April, it has stressed that the parties' complaints have to do with wage cuts, removal of additions or inadequate treatment between the positions stipulated by law. In a sign of dissatisfaction with the Law of the Salaries, the complaint to the ombudsman had also been sent by the Kosovo Police Union. The head of this union, Imer Zeqiri, revealed to Radio Kosovo the requirements they have.

Zeqiri says he is unwilling to intervene in the work of the Constitutional Court, believes their demands are acceptable.
Juristi Gzim Shala from the Kosovo Institute for Justice says it is good news proceedings for constitutional assessment of the Law on Salaries. According to him, this law can be declared unconstitutional.
What we can say about this case is that based on international standards, the Constitution of Kosovo and the standards that the tribunal itself has defined, in the case of addressing the last law on wages, even this law does not pass the filter of the Constitutional Court. But not necessarily the Constitutional Court could annul the whole law for wages. If he finds specific violations, he may decide to cancel only certain provisions, rather than a total of”, he said.
The Kosovo government had decided that the value of the cofficiency would be 105 euros for 2023, 110 for 2024.
