Constitutional Sinned Day - What violations of the Constitution are the Kurti Government accused of?

Today, it has been 15 years since the adoption of the Constitution of the Republic of Kosovo. Fifteen years later, the highest legal act is often neglected by being violated and disrespected by politicians and government officials over the years. On the 15th anniversary, we are counting violations made by the Kurti Government alone.
The 15th anniversary of the Constitution's adoption was among the country's greatest achievements, shortly after its declaration of independence.
Over the years, the Constitution has been the centre of violations of its provisions by government officials who have led Kosovo.
Amazingly, violations of the Constitution also took place in the Kurti Government, as the promises of Vetevendosje officials while in opposition showed us that the Constitution would be fully respected.
Kosovo's prime minister, when questioned about the National Union, turned out that he had read the Constitution, however, until at least 1.3.
It's been 15 years, but it's not 15 violations, the text below shows some of the paperwork made during Albin Kurti's rule.
First Sin
The first offense occurred during the time of the David-19 pandemic. The closure during this time was a violation of the Constitution under the Constitutional Court's ruling.
This court, which is a defender of the Constitution, found that fundamental rights and freedoms of citizens were violated.
“T E THE decision was no. The Government of the Republic of Kosovo, March 23, 2020, is not in agreement with Article 55 [Religion of Constitutional Rights and Freedoms] of the Constitution regarding articles 35 [Freedom of Movement], 36 [United Rights] and 43 [Freedom of Rally] and Article 8 (Right for Respect of Private and Family Life), 11 (Freedom of Collection and Organization) of the ECDN and at 2-Linance of Protocol. 4 at KEDNJ;” said in the Constitutional decision.
Second Step
The second time, it had to do with the David 19 pandemic.
This time, Kurti's decision to establish quarantine and take revenge on those who did not comply.
The Third Sin
The third violation of the Constitution was carried out by Education Minister Arberie Nagavci.
Under the Constitutional Court's decision, Minister Arberi Nagavci had stepped in to the competencies of the Kamenica Community for education reform initiated by the former chairman of Kastrati.
The decision stated that the AugustI through the teaching decision “has exceeded competence and violated municipal responsibilities, respectively, has interfered with the personal competencies of the Kamenica municipality in terms of providing public education, contrary to constitutional and legal guarantees”.
For this case, Nagavci had made a reaction saying he would analyse the Constitutional Court's decision.
The Fourth Sin
In March 2023, the Constitutional Court found that Justice Minister Albulen Haxhiu has violated the Constitution.
The court declared anti-unconstitutional Law for the Prosecutorial Council, which was drafted by the justice minister.
Minister Haxhiu, regardless of why she was found in violation of the Constitution, when she was asked by reporters whether she would resign, had indicated she did not think she would resign.
“for what to resign. Maybe it's good to ask the opposition why they're looking for him. She said, among other things.
Meanwhile, the Constitutional Court's decisions are often disputed. Kosovo Prime Minister Albin Kurti did the same during the recent debate in Rubikon, writes Nacionale.
“How do I know that it will fall from the Constitutional Court a law that has twice passed the Venice Commission, which has agreed with the US, the EU, Britain, with civil society, and is not enough the Venice Commission, but comes and falls here at the Constitutional Court”. He had said after the KPK Law's anti-unconstitutional proclamation.
Otherwise, other laws drafted by Kurti Government have been submitted to the Constitutional Court.
The Law for the Bureau, the Law for the Salaries, the Law for Public Officials and the Law for Seting ceiling prices for essential products are some of the laws that could be declared unconstitutional, and the list of constitutional violations could change.
Meanwhile, at this anniversary, opposition leaders have mentioned violations of the Constitution made by the government Kurti.
Chairman The PDK, Memli Krasniqi, of LDK, Lumir Abdijxhiku and AAK's Ramush Haradinaj, have, through Facebook writing, accused Kurti Government of violating the Constitution.
Otherwise, the Kosovo Constitution was ratified on April 9, 2008, and went into effect on June 15, 2008.
