Seven years and four months and 28 days. So long, Kosovo's justice attempts were to whiteen the case of Donjeta Pajaziaj's murder. Twenty-four-year-old from the village of Ulch of Decani ʹ western Kosovo was killed on November 9th, 2015, with two bullets in the head.  

Even 2,705 days of her murder, Killer He is still free and unknown to justice organs.

For 38 days in 2015, the Pajazi family knew nothing about Doniata until her body was found decomposing in the Sherlch Pea. A few days later, the family members learned that the main suspect in her murder was their next cousin, Naser Pajaziaj, then 60 years old.

After 10 court rulings, where he was acquitted and on occasion sentenced to life imprisonment, Naser Pajaziaj was acquitted of all charges on April 6th, 2023. He got out of prison and went home, writes Radio Free Europe.

For the last time, Donjet had been seen not far from the neighborhood where she lived, as was Naser Pajaziaj.

From the day of arrest to the release of Naser Pajasitaj, nearly 5 years and 10 months passed.

During this time, family members have been added to the pain of continuing judicial processes.

“We just think it's ending... or it's turning into retrial, or decisions are being annulled. This is too heavy. We can't agree. Only Inshallah, if not by justice, the punishment from God sometimes gets”, said Donita's brother, Shkelm Pajaziaj.

I wake up in the morning with that thought... I still think it's alive”, he said.

Over the years, Lumniya and Elevation were constantly confronted with events on November 9, 2015, in judicial halls as far as Pec, Ferizaj.

November 9, 2015

Donjeta Pajasitaj was allegedly killed the same day with two bullets in his head on the road leading to the Strellc village mountain in the Decani municipality.

What was said in the indictment?

The indictment stated that Naser Pajasitaj, November 9, 2015, had taken his cousin Donyette, a few yards from her home by car. Later, it was said he had taken the 24-year-old several miles away, where he had killed him with two bullets in his head. He was accused of covering Donjata's body with wood and leaving the scene of the crime.

Investigations and judgment have focused mainly on Pajaziaj's alibi, witness statements, which allegedly saw or contacted him and tracking conversations and phone calls. The prosecution had found that Pajazi's claims, in some cases, did not match the provided evidence.

One of the prosecution's main arguments was that the accused's alibi did not stand, since data received from an antenna showed that a call had been made from the accused's phone during the time he said he had been elsewhere.

After the trial, Peja's Constitutional Court frees him from charges of murder Naser Pajazitaj, as he is not able to prove that he was the boss of the crime. He's only convicted of illegal possession by 2 years and 4 months in prison for the AK-47 gun, which was found in the bedroom on the day of his arrest.

March 25, 2019

Naser Pajazitaj is sentenced to life in prison for the murder of Donjeta, in the second trial of this case at the Pjajajare Foundation Court. The prosecutor of the case, Valbona Dishaj-Hajoya, had said that it has been proven in all that the accused Pajasitaj had committed the murder “by exploiting the victim's confidence and inadequacy”.

The Supreme Court breaks down the two previous judgments of the Pella Constitutional Court and the Court of Appeals, turning the case into retrial.

January 20, 2020

The Court of Appeals rules out the new trial of the Pec Foundation Court. This case passes to the Ferizaj Foundation Court to remove any suspicion that the judgment will be fair.

May 27, 2021

Even the Foundation Court in Ferizaj convicts Naser Pajazitain and sentences him to life in prison.

November 30, 2021

Again, the Court of Appeals turns the case into retrial, cancelling the Constitutional Court Act in Ferizaj.

June 23, 2022

In the retrial, Ferizaj's Foundation Court again condemns Naser Pajazitain to life imprisonment.

November 18, 2022

The Court of Appeals reduces the sentence to Naser Pajazitaj from life imprisonment to 35 years in prison.

April 6, 2023

The Supreme Court clears it of all charges Naser Pajazitain. He comes out of jail and comes home.

News that the Supreme Court cleared Naser Pajazitain of the charges even more disappointed the Honor, Donita's brother.

From today on, we have no faith in either the Police, the Court or the Prosecutor, when for seven years they were unable to reveal the truth. The state is killing”, he wrote in his Facebook account.

Nongovernmental organizations have constantly designed the legal organs for the treatment of the case.

In the Kosovo Assembly on April 6th, Justice Minister Albulen Haxhiu also criticised the Supreme Court's decision.

For me, it is unacceptable that a person, who is sentenced to life imprisonment, is so easily released from charges”, she said.

Since 2010 until the end of 2022, 50 women have been killed in Kosovo, while suspected or accused authors have in most cases been mates. Nongovernmental organisations have criticised justice organs for failing to protect and whiteen these cases.
