Perrit, American professor at Chicago-Kent Law College in the United States, was very surprised when she saw the 35 point of indictment against former Kosovo Liberation Army leaders for “joint criminal enterprise”, because, according to him, if the KLA and its leaders are punished for such a deed, then this [...]

In an interview for Albanian Post, Henry H. Perrit, who has also written the book “Kosovo Liberation Army within the History of a Uprising”, says that if the Special Court were to condemn Hashim Thaci, Kadri Veselini, Rexhep Selimin and Jakup Krasniqi, then it would eventually rewrite the International Law.

“Here can be rewritten the International Law on Armed Conflicts”, says Perrit, because “under the theory of Specialised Prosecutor, any guerrilla uprising in history will be the joint criminal enterprise”.

With the authority of the law professor, specialisation in guerrilla uprisings and detailed recognition of the Kosovo Liberation Army, Perrit claims to Albanian Post that “U n The CK was not a joint criminal enterprise in any legitimate sense of the term”.

“U n The CK was a typical guerrilla uprising, motivated by nationalism and determination to resist what was considered to be the occupation of Albanian territories from Serbia”, explains Perrit, for the first time in history The KLA had heard in 1996 when it was working on a project for Bosnia and Herzegovina until 1998, it decided to visit Kosovo itself and see closely what this nationalistic liberation movement is that has perfected what the theory knew as “4 GW”

Perrit had started writing the book for The KLA was able to publish it only in 2008, after several years of study. The idea of writing had come at a very unusual time and place.

The book began with a conversation with a waiter at the Victoria Hotel in Pristina. He was 22 years old at the time, beautiful, pleasant and a little shy. He was a former KLA soldier. A long conversation follows. What had done this tiny, clearly soft kid to catch an AK-47 and risk his life?

Known by the theories of guerrilla uprisings, inspired by conversation with former waiter fighter, the American professor put in a several-year study, interviewing all KLA military and political leaders, all KLA critics and opponents, and consulting all documents he found, to come to the conclusion that “U n The CK was one of the most successful post-war uprisings, although it operated relatively in a very short period of armed conflict”.

Perrit would conclude that the KLA is the best illustration of what the theory knew as “The Fourth Generation War (4GW), a term meaning integration of military and political aspects into battle”.

What surprised the connoisseur of guerrilla armies was the fact that the great success of The KLA did not comply with the weak command structure.

In this interview for Albanian Post, he claims “U n The CK had a very weak and uncertain chain of command, even though the so-called General Steadab was much defeated during the conflict that the regional commanders who were too autonomous to forward the guidelines of the General Staff”.

Although the KLA also fell into the patron of most other guerrillas around the world, two elements had surprised the American professor, who were unique compared to similar movements around the world.

And unlike other uprisings, The KLA did not launch terrorist attacks on civilian targets”, it found Perrit. “Also, even though the KLA uprising was held in a region where the population was the overwhelming Muslim majority, they refused bids for aid from Islamic fundamentalists”.

After studying the KLA operation, Perrit concluded that “perience with the KLA shows that not every Muslim people slips into Islamic fundamentalistism and combines themselves with such groups, especially when there are essentially nationalist goals”.

Perrit had found in archives that “U n The CK listened to the United States, when through the CIA you were told that you were no longer involved with Islamic extremists.

For these and other reasons, Perrit tells the Albanian Post that “The NLA and its leaders are punished, then the credibility of the International Law on Armed Conflicts will be severely violated”.

He recalls that even the <x0 NATO integration was done under the argument given at the time”, for these very reasons.

But even today nothing has changed in those arguments”, Perrit claims the AP.

Perrist, apart from academics, he is also the S-Candidad of Democrats for the House of Representatives at the US Congress. He once served at the Ministry of Labour in the US President Gerald Ford's cabinet, and then for President Bill Clayton as part of the transition team.

Later, in 2010, he would also write a book on Kosovo titled “on the road to independence for Kosovo: A chronice of the Ahtisaari Plan”.
