Former American diplomat and Balkan Affairs connoisseur Daniel Cerwer has today declared that the Special Court has a mandate based on Kosovo laws and on claims reported by Dick Marty in the Council of Europe Parliamentary Assembly Report of January 7, 2011, but that court has emerged from this mandate.
I'm not a lawyer, but in my manner of secular thinking, the court is clearly removed from this mandate. It appears that he has forgotten the report of the Parliamentary Assembly of the Council of Europe”, he has said in an interview for Deutche Welle.
The key claims in the Council of Europe report appear to be groundless and have been dropped off charges against the accused. Serwer considers that Kosovo made a mistake to establish the Special Court without reciprocal agreements with Serbia, so Belgrade too will have a court of jurisdiction for crimes against humanity, war crimes and other crimes within Serbia, where three American brothers (Bytyci brothers were killed immediately after the war in 1999).
Serbia was the main wrongdoer in the 1990s. The unilateral nature of the Specialised Chambers and the Prosecutor's Office prevents this court from establishing justice for crimes committed by Belgrade”, Serwer has declared.
He stressed that the judgment is already worsening frustrations in Kosovo, calming feelings in Serbia and making it more difficult for Pristina to normalise relations with Belgrade.
