This agreement was reached at the level of chief negotiators on April 6th between Besnik Bislim and Petar Petkovikiki and was made for fierce debate on what had actually been achieved. That's because this deal had been close for a long time, but it was stuck only in harmonizing two sentences in the general text for which there had been reconciliation before. Serbia has already flatly refused to have links with people missing by violence and has refused to bear judicial consequences for their disappearance. On the other hand, Kosovo has insisted precisely on this.

A compromise seemed to be found among them. Serbia is not responsible for the disappearances, Kosovo is not indifferent to the nature of the disappearances. There will be no term “that has disappeared by violence” (ang: Enforced Disappreance, according to the International Convention for the Protection of Persons Missing From Violence, but it will have the term “strongly abolished” (ang: forcibly disappeared) that is not a legal category. This is because for the first term “Enforced Disapperance” Only states are responsible. Serbia presented this as a victory, while Kosovo presented it as the second.

Declarations about the agreement on the missing persons and Andy Hoti and Veljko Odreovic:

Prestina was not a state then, nor is it today. [Kosovo has declared independence in 2008 and is internationally recognised by 117 states]. It has no responsibility for the disappearances that took place in the 1990s. It says that only the Republic of Serbia is responsible for the disappearances and sufferings of Serbs, but also for the disappearances of all the others”, said Oldrovic, as long as you disputed that the burden should not necessarily fall on the state of Serbia, and even assessing that Kosovo is creating the “process.

But, Andy Hoti, who is Chairman of the Commission for the Undiscovered Persons of the Kosovo Party, however, says that, “for the first time in 24 years, we were able to impose the proper address of responsibility for the missing, as victims of war seeking solutions and justice on the basis of international conventions”.

The “therefore will not only be missing persons, but persons missing violently from the Serbian state”, he says convinced.

However, the extent to which it stands, “from the Serbian state”, is extremely unclear, because the term “legally dissapealed” is not found in any international conventions as a legal category that would hold Serbia accountable. And even that, Serbia presents it as triumph.

This is important because of families of all those still missing. I would add only that we have had special care for all the conditions, and that we have not accepted the term violence management, because we have taken care of not risking the interests of the state of Serbia”, Petkovic says.

The term, which is not a legal category and is not found at any international convention, but only describes the situation/circumcise of how extinction took place and therefore cannot produce any legal consequences to the interests of the state of Serbia, nor its responsibility”, he said.

Only after this issue became a form of debate came the reaction of Kosovo Prime Minister Albin Kurti, who gave the exact term over which it was hired in the text. “Especially dissapered”, he indicated.

“The exact English formula is strongly modified and so is the term that is agreed upon and located on the content of the agreement. Even when it is declared, it will be said of the dead, missing, missing, missing; it is always a matter of violent destruction. )Forcibly severalppered, this is the English expression already agreed on in Brussels”, Kurti has said.

In a conversation with Nationale, former head of the OSCE Verifiable Mission in Kosovo William Walker says the term that is in the UN's official language had to be adopted. I prefer the version that has the official language of the United Nations, and I guess why Serbs would prefer the most appropriate term (forcibly disappeared). According to my small role in these issues, the best term is that of the United Nations”, Walker said, while for the term that has been adopted, he doesn't know what it marks.

I'd like the term to be assitically for governments to be responsible for the disappearances instead of just saying "forcibly dissapeaed" because that sounds to me like they could be any reason for extinctions. But if Albin Kurti and the Kosovo government accept this terminology as presented then it is done. And if the Serbian government presents this as a victory, it is similar to the Serbian government”, he told Nacional.

Serbia presents this as victory because it is not responsible for their disappearance. So at least a number of times Serbian side chief negotiator Petar Petkov was declared. If this is their comment, which has preserved state interests, it's a pity. If they say the Serbian government is officially not responsible for some of these disappearances, that is simply not true. They must provide an account for the disappearance”, Walker said.

But that is not all. Walker also has a story to mark a difference in time as chief of the Verifiator Mission. Actually, by the way, I'm writing a book. Me and a woman helping me, and my friend Hasan, we were looking at videos of my meetings as head of the Research Mission with the Albanian families of the missing and later we were watching videos where we met with Serb missing families day after day; and there were two extremely different meetings”, he said.

The meeting with the Albanian family of the missing was, as I say, very positive, they told me their story and asked the KVM to help find their families or tell them what happened to their missing ones, and that was in the first few days. My answer was you give us as much information as you got: when they disappeared, where they disappeared, whatever you have. While meeting several days later with Serbian families was quite another; it was extremely confrontational meeting, where they told me: Oh you KVM get out of here, go get us family, you know where they are, you know the KLA is holding them. And I was just saying, sorry, but we don't know that. It was a whole different date, says William Walker.

So, in the sense of the subject of the unsurgents, I was a little frustrated by the attitudes of the undiscovered families. Here we are, 23 years later, just like you described, just to get a document that describes the matter and how we can solve it, there are now arguments between these two words”, he says, among other things.
