Nothing prevents Trump from competing while charged, or even convicted”, said Richard Hasen, professor of law at the University of California.
The constitution requires only three things from candidates:
- Be a citizen born in the United States;
- Be at least 35 years old;
- Be US resident for at least 14 years.
As a political issue, it may be even more difficult for an accused candidate, who could become condemned, to win votes. Trials do not allow candidates to move away in the best way, but this does not prevent them from competing or being chosen.
There are a number of inputs in the Constitution and in the amendments 14 and 22, none of which are currently used in Trump cases believed to be approximately formal punishment.
Time Limits. The 22nd embassy prohibits anyone who has twice been president to run again -- implying that he has been elected twice or squandered part of someone else's mandate and then his or her mandate. That's not true of Trump because he lost the 2020 elections.
Impeachment. If a person faces impeachment from the White House and then is sentenced by the Senate for a high crime, he or she leaves the office and is disqualified from office again. Trump, although faced twice with impeachment during his mandate, he had also been saved twice by the Senate.
Disqualified. The 14th embassy included a “cule disqualification”, written specifically with an eye towards former Confederate soldiers.
