Due to the lack of indictees, Minister Jedal Svecla, as well as Dardan Moliqaj, Pajtim Havoll, Arsim Maqastens Agron Kabashi, Frasher Krasniqi and NoI Nusshi, Pristina's Constitutional Court at Wednesday's session, has decided to isolate procedures against them.

Meanwhile, the session continued with three other defendants present at the session: Egon Azemi Pacim Demaj and Africa Hoxha, who have declined to isolate this procedure, but the court based on Article 35 of the Penal Procedure Code made a decision and singled out the criminal procedure against them.

Following the separation of course from Judge Gashi, the hearing followed the reading of the indictment by prosecutor Besart Gashi with the prosecution's case of Demaj and Africa Hoxha declared innocent, adding that this is a political indictment.

Chief indictee Egzon Azemi has initially handed over to court judges in the Eroll Gashi case a health documentation in which, according to him, is said to have to carry out a health visit, saying that for this reason he cannot stay at the session, but once he receives health paperwork, Judge Gashi said there is nowhere to notice a term for today.

Following this refusal by Judge Gashi, accused Azemi tried to leave the courtroom, telling them the right to medical examinations was being violated.

He has then refused to answer the court's questions.

After completing the procedure of their statements regarding confession or not of guilt, today's hearing was concluded by Judge Gash, announcing to the parties the right to submit the demand for rejection of evidence and throwing the indictment in the 30-day term.

Otherwise, the initial review hearing in this case had failed to be held on 9 March this year in the absence of indictees Dardan Molliqaj, Agron Kabashi, Egzon Azemit, Pacim Demaj, Frasher Krasniqi and Nol Nushi.

In this case, Sami Avdiu, Besnik Celay, and Bekim Shkodra were also charged, but the court had singled out the criminal procedure against them.

To Besnik Qeyal and Bekim Shkodra had also become a judge on August 2, 2022, being sentenced to 1 year and a half in prison on bail for criminal work “Crowd participation committing criminal acts and hooliganism”.

Meanwhile, to accused Sami Avdiu of criminal work “The crowd taking part in criminal acts and hooliganism” and accusing Bekim Shkodra of criminal work “Attacking the official person while carrying out official task” will be held a special trial.

In the indictment, provided by “Justice Vowtim”, established in March 2014, results in charges of this criminal act along with Minister Svecla are Dardan Molyqaj, Arsim Maqastena, Pacim Havoli, Agron Kabashi, Egzon Azazi, Pajtim Demaj, Frasher Krasniqi, Noushi, Bekim Shkodra, Andrim Hoxha, Sami Avdiu and Besniki.

According to the indictment, at the protest organised on June 27, 2013, against ratification of the agreement on normalisation of relations between Kosovo and Serbia, the accused have thrown stones, color, glass spheres, bottles and pyrotechnics towards some police officials, with the result of minor injuries to four policemen and four official vehicles being damaged.

Indictee Bekim Shkodra is also being charged with the criminal act of assaulting the official person during the official duty.

According to the indictment set up on March 14, 2014, by Pristina Constitutional Prosecutor Dardan Molyqaj, Arsim Maqasten, Arsim Havoli, Agron Kabashi, Egzon Azemi, Pajtim Demaj, Xhelal Svechla, Frasher Krasniqi, Nol Nushi, Bekim Shkodra, Afrem Hoxha, Sami Avdiu and Besnik Celaj are said on June 27th 2013, at “below the Tenez” in Pristina, during the protest with the intent of hurting members of Kosovo officials from violent police officials have committed violent acts.

All in accordance with this indictment, Svecla and the other accused are charged that during this protest, stones, color, glass spheres, bottles, pyrotechnics in the direction of members of the Kosovo Police, with the result of these actions, slight bodily injuries the police have suffered Rift Geci, Halil Syla, Agim Xheli and the Hyseni Union.

According to the prosecution, material damage has also been caused during the protest, where official uniforms and equipment of police officials were damaged during maintaining public order and safety, and have also damaged two cars, Kosovo Government property and two Kosovo Police owned cars, causing serious consequences.

With these actions, the prosecution charges the accused that each alone committed criminal work “The crowd's participation in criminal acts and hooliganism” by Article 412, paragraph 3 related to paragraph 4 of the Penal Code, which provides penalty for a fine fine of 200 to 10 thousand euros for hooliganism with minor consequences or prison of up to five years for hooliganism with serious consequences.

While the second device of this indictment, Bekim Shkodra is also tasked with the criminal act of “The attack on the official person during the performance of official duty” by Article 410, paragraph 2 of the Penal Code, which the chief is sentenced to imprisonment of six months to five years.
