Trial against former AKI official charged with corruption again shuts down for public

Otherwise, forensics expert Shqipe Salihu, from the Criminal Technical Directorate, the Department for Photo, Video-Analysis, and the analysis of information technology equipment, reports the “Justice Trust”.
Responding to the alleged defender Krasniqi's questions, attorney Fanol Krasniqi, expert Salihu, has said that on November 22nd, 2021 the ordinance for examination of the equipment has been accepted, and on January 17th, 2022, completed the examination, which was conducted at the AKI facility.
“On page 2, dot 3, with November 22nd 2021, the Constitutional Prosecutor's opinion has been accepted with the request for the examination of the equipment, with November 25, 2021 started testing, while on January 17th, 2022, the review was completed”, she said.
On the other hand, regarding the lawyer Krasniqi's question to extenuating Salihu regarding computer users, Judge Foniqi, in order not to reveal the names of AKI officials, has demanded the parties' opinion on closing the session for the public.
Prosecutor Zenjulah Gashi has agreed with the opinion of the court. So, based on Article 289 of the Criminal Procedure Code, today's session is closed to the public.
Even the September 26, 2022 hearing, was closed to the public because witness testimony could be violated by the agency's sensitive information.
Otherwise, the second review of the case was held in opposition to the law, as Judge Foniqi had held the hearing in the absence of accused Krasniqi.
Meanwhile, in the initial review held on March 10th 2022, the accused Krasniqi was declared innocent of criminal acts that he is being charged with under the accusation.
The Basic Prosecutor in Pristina, the RS Department of Criminals, on February 23rd 2022, has filed charges against indictees Muhamed Krasniqi, for criminal acts “due to the use of official position or authority”, “Kestum use of official information”, “access to computer systems”, “Detail of classified information and not preserving classified information<7> and “Photo and other unauthorized recordings”.
According to the first point of the act, the accused Krasniqi, on 17 September 2020, August 25th 2020 and March 11th 2021, at the Kosovo Intelligence Agency and contrary to the law, as an official person in the quality of the AKI official, is accused of overstepping his competencies and failing to fulfill his duties.
The indictment says without authorization it has intervened in the AKI computer system, unauthorising the program for monitoring other computers “Net Monitor for Employe Pro”, from which the program has infected 55 other computers within the AKI headquarters, and installing the software software software file “Vejon”, where it violated the rights of other employees, creating unauthorized access to the content of the officials had in possession, as well as misusing its software authorisations (designs) and post-designing the files that it used for obtaining access to documents and obtaining software.
With that, Krasniqi is accused of committing the criminal act of using the official position or authority” by Article 414, paragraph 1 concerning paragraph 3, points 3.1. and 3.4. KPC's.
At the second point of the indictment, Krasniqi is charged with using the “Net Monitor for Employes Pro”, and the software program file “Veyon” , which is documented that they were installed on computers he used in the AKI network, has created access to employees' computers and projectors within the AKI communications network, from which he has access to each infected computer activity, seizures, payment of passwords, videos, use of the user's activity, are thus charged that he has reached the general wiretrespons of the fugitives, and various job workers, without authorisation files, and operatives.
As of this, Krasniqi is charged with criminal work “Using Official Information” by Article 416, paragraph 1 concerning KPRK paragraph 5.
In contrast, according to the third point of the act, Krasniqi by misusing official duty has installed software “Net Monitor for Emplores Pro”, and software file “Veyon”, in the internal communication network of AKI, through his two computers and has created access to 55 other employees' computers via “Agents of the programme”, where he allegedly accessed information from the computer systems of AKI employee, and had the software installed <6m) and installed <XNeplories on his web site, and installed on his own computer.
With that, Krasniqi is accused of committing criminal work “access to computer systems” by Article 327, paragraph 1 of KPRK.
Likewise, Krasniqi, according to the 4th point of the indictment act, having access to classified AKI units documents, which were found on his computer at the AKI facility and computer at his home, is accused of copying and storing those classified documents, which were not to be issued outside the AKI units' classified documents, with a secret level and over secret, general and single-smartial documents, accused of copying and storing those classified documents, which were not to be released outside the premises, and of being indicted as a criminal group: Agim Krasniqi, Aif Krasniqi and Arif Krasniqi, who have been investigated by police because of suspicion of criminal acts.
For this, Krasniqi is charged with criminal work “The discovery of classified information and the failure to store classified information” by Article 125 of KPRK, concerning Article 50, paragraph 3 of Law No. 03 L-178 for the information classification and security verification.
While, according to the indictment's fifth point, Krasniqi is accused of misusing his official duty and misusing the information he had about the AKI video-monitoring system, the same is accused of being introduced into the video-monitorial system and has made the unauthorised photograph of at least two officials within AKI objects.
For this, Krasniqi is accused of committing criminal work “Photo and other unauthorized recordings” by Article 202, paragraph 1 concerning KPRK paragraph 3.
