Full communication:
The Kosovo Judiciary Council (KGJK), at the meeting held on February 2nd 2023, along with the Courts and Judges Assembly, has discussed and analysed Law No. 08/ L-196 for Salaries in the Public Sector and the Government of the Republic of Kosovo's decision on the value of the cofficiency, as well as the effect of these acts on the judicial system.
The Judiciary Council considers that the Law for Salats in the Public Sector and the Government of the Republic of Kosovo's decision on the value of cofficients presents an harmful intervention in independence, integrity and the functioning of the judicial system.
Such interference in the judicial system is in full opposition to constitutional, legal and European standards guaranteeing judges a predictable wage system and preventing wage reduction. Moreover, such an approach to the judiciary is contrary to the Constitutional Court Act, the Law for Courts, the stability of the Venice Commission and the recommendations of the European Judges Consultative Council.
The Kosovo Judiciary Council and the entire judicial administration express concern that neither the Parliament nor the Government have respected the Constitutional Court's decision to ensure the privacy of the judicial system's wages, so we invite the ombudsman to act under legal competencies by opposing this Law in the Constitutional Court.
The Kosovo Judiciary Council is determined to take all constitutional and legal actions to protect and promote institutional and functional independence of the judicial system.
